Question: What obligations does a seller have on the condition and cleanliness of a home when it transfers ownership?

Answer: Many sellers apply The Golden Rule of treating others how you wish to be treated and convey their home in the condition they’d like to move into a home. Unfortunately, this rule isn’t a contractual obligation so let’s take a look at what the contract states and some common points of contention.

Contract Language on Property Condition

The Northern Virginia contract states that the “Seller will deliver Property free and clear of trash and debris, broom clean and in substantially the same physical condition to be determined as of [Select One] Date of Offer, Date of Home Inspection, or Other [as defined in contract].”

If you’re doing a home inspection, use the home inspection as the date of determination because there’s a documented property condition report.

All systems, finishes and fixtures convey in as-is condition as of the time period selected in the previous statement, unless otherwise noted in the contract. Electronic components/devices don’t convey, but all related mounts and hardware do (e.g. TV goes, the wall mount does not).

Your Final Walk-Thru 

The final walk-thru is your opportunity to catch any property condition issues before they become your problem. Once you sign the paperwork any leaks, holes in the wall, or faulty systems are yours to deal with.

While the contract allows you to do a walk-thru as early as seven days before settlement, I recommend doing it just before you sign the paperwork to reduce risk.

Common Points of Contention

Pre-Existing Condition — During the final walk-thru you find a hole in the wall that was previously covered up by a large piece of furniture. If the hole existed prior to the contract, the seller has no contractual obligation to address it.

If a faulty water heater leaks and causes damage in the basement, the seller must clean up the leak and repair any damage the leak caused, but likely won’t be obligated to replace the faulty water heater.

Get it? The seller’s obligations revert back to the as-is condition at the point in time stated in the contract (date of offer, date of inspection, or some other defined time), unless a separate addendum is created that provides other direction.

Clean or Dirty — Broom clean doesn’t mean “clean” in the way most buyers want to arrive to their new home, so plan to hire professional cleaners prior to moving in. On the other hand, it’s normal for sellers to leave behind paint, lawn tools and cleaning supplies.

You should confirm the buyer wants these prior to leaving them behind or you may be scrambling to clear them out at the last minute to remove “trash and debris.”

Nails and Screws — Do you have a bunch of nails and screws left in the wall after removing photos, art and shelving? Leave those in place otherwise buyers can make a case that the physical condition of the home changed due to all the new holes.

Contractual obligations are not what most of us would consider the right way of doing business. That’s why I stress maintaining a positive relationship between all parties during negotiations so that when something unexpected comes up, it’s handled with care and consideration instead of contractual force.

Ring doorbells were not a hit on the show Shark Tank when inventor Jamie Siminoff first brought his project to the sharks.

However, that did not keep him from launching the product in 2013 and in 2018, Amazon bought his company for $1 billion. Now though, Amazon has had to scurry to fix a security flaw in their Ring doorbells that actually posed a danger to homeowners instead of keeping them safer.

The Ring doorbell is a smart doorbell. When someone is at the door and presses it, the homeowner can see through a camera in the device who rang the bell. The device also allows homeowners to open their door remotely to let someone they know into the home. Recently though, a hack has been exposed that tricks homeowners into letting thieves and criminals into their home.

So, how does the scheme work? Those wishing to interfere with the device hack into a homeowner’s Wifi network at the same time the homeowner is connected. Once connected, the hacker can then see the video and hear the audio that is transmitted from the device.

The element of the hack that is even scarier is that hackers can also insert their own video into the feed. They may use footage of a trusted person ringing the doorbell to get the homeowner to remotely open the door when that trusted person is not actually there.

Instead, the hackers are waiting to be granted entry. The dangers of this type of negligent security are quite clear. If someone’s not in the home, thieves could take whatever they wanted. If someone was in the house, particularly children, the dangers become much greater.

“It is good that Amazon took quick action on this security flaw before anyone was seriously hurt or had their home invaded,” says Jeff Shiver of Shiver Hamilton. “If they had waited much longer, they would have certainly faced lawsuits from homeowners that entrusted both the company and the device with keeping them safe.”

Indeed, Amazon has fixed the device. In their latest software update, they corrected the glitch that allowed hackers into the device. All Ring owners need to do now is update the Ring app. This will install the fix, and keep their home secure.

Amazon recommends installing all updates as soon as they become available to keep Ring doorbells working in the manner they were intended.

If you’ve ever had a dog that gets nervous around thunderstorms or a cat struggling with arthritis, you know that pets often have problems that we want to fix, but they seem unsolvable.

As owners, it is hard to see your pet suffering and feel powerless to help. For some health troubles, however, there may be a new solution: CBD.

What, exactly, is CBD? Its longer name is cannabidiol, and it is a compound found in the cannabis plant, which, yes, is primarily associated with marijuana. Perhaps the most important thing to note is that CBD won’t get your pet high. Cannabis has another compound, called tetrahydrocannabinol, or THC.

It is the main psychoactive ingredient in marijuana and what leads to the high for humans. Even though it comes from the same plant, CBD does not have psychoactive effects on humans or animals, and it is becoming used more frequently for health issues in humans. Recently, vets have begun realizing it can be helpful for animals as well.

CBD Can Help Reduce Anxiety

If your dog barks excessively, exhibits destructive behavior, or seems overly restless whenever you leave the house, there is a high chance they’re suffering from separation anxiety.

Just like in humans, CBD can help relieve anxiety so your dog can be calmer when you’re not home. It can also help reduce anxiety associated with noise phobias, so that your dog won’t cower every time there’s a thunderstorm or fireworks nearby.

CBD Can Treat Seizures and Epilepsy

This is a common use for CBD in humans, but pets can also suffer from seizures, and CBD can help. There are other medicines often prescribed to help animals with seizure activity, but these can be harmful to their liver and may not always work.

CBD Relieves Pain

It is well-reported that CBD has been effective against various types of pain, including inflammation and nerve-related pain. It can also help alleviate the effects of arthritis, helping with joint and mobility pain.

CBD Can Help with Appetite and Nausea

Although humans often report getting the “munchies” during or after consuming marijuana, your pet doesn’t have to get high to feel this effect. If your furry friend isn’t showing much appetite, CBD can help get them to eat. It’s also been shown to help with vomiting and nausea, even when toxins or drugs cause these symptoms.

CBD Might Help Fight Cancer

Preliminary studies and anecdotal evidence have suggested that CBD can have an anti-tumor effect, stopping cancerous cells from growing and increasing tumor cell death by blocking their ability to produce energy.

It’s important to remember that the effects of CBD are still being studied, particularly as they relate to animals. Not every company that offers CBD for pets is trustworthy, so always be sure to do your research before buying a product for your pet. Since CBD is still not legal at the federal level, in most states veterinarians aren’t allowed to bring up the topic with their patients.

But if you think CBD might be helpful to your pet, don’t be afraid to talk to your vet about it. If you do decide to try CBD, it’s crucial to purchase products specifically made for animals. Human CBD products often still contain small amounts of THC.

While this compound produces a high for humans, for animals it can be toxic, even in the small doses found in human CBD products. CBD may not turn out to be the magic cure-all for every problem our pets have, but for many owners, it offers them another way to help their furry best friends.

In the second room of Tomb, not only will the solution to the jar puzzle be different each time but Pharaoh will adjust the complexity and the speed of the puzzle to match your group’s skill.

Manager Dawn Charbonneau says that everybody can go to 5 Wits, but “people seven years old and up” are best — because although the games aren’t designed to be scary, kids under seven might still find the noise a little frightening.

Adventures begin every 15 minutes, and take about 30-60 minutes to complete.

Hello there, denizens of ARLnow.com. It’s been a while. For those of you who weren’t here the first time around, my name is Nick and I used to write a column here back when I was the beer buyer at Arrowine.

Now that I’m back at Arrowine — which I didn’t expect to happen but has been great so far — I’ve been asked to jump back in the pool here, which I really didn’t expect.

So it’s been what, almost four years? How are you all? What’s new? I’m back at my old job but my life couldn’t be more different: I’m a dad now, for one thing, which is awesome.

There are a whole lot of restaurants in Arlington that used to be other restaurants. It’s been nearly whiplash inducing trying to keep up with who has been opening and closing over the last couple years.

The beer scene in our area is a lot different now, too. So. Many. New. Breweries. That’s the story: new breweries popping up in every corner of the area. With new breweries and new releases coming out week after week, it can be a little overwhelming to try to follow along in the era of FOMO.

What hasn’t changed is the continuing hunt for the latest and greatest, the rarities and nerdbait from all over the country — nay, the world. But while it seems these days you can pick up a dozen new IPAs during any given week if you like — and don’t get me wrong, I will not discourage you from doing so — there’s a lot more happening than just Haze.

We’re also seeing a revival of Lager; European brewers finding new/renewed relevance thanks to new means of packaging bringing them to the U.S. in better condition than ever; the rise of the trend-chasing “things that taste like other things” approach in the beer world, some of which are great while others are… less great. (Note: we’re totally getting into Hazy IPAs first, though)

I don’t really know yet where the column is going this time around, which I guess means that hasn’t changed from before either (lolz). I’d like to profile these new local breweries, so you might get to know them better.

I might occasionally “think out loud” about some of the trends we’re seeing in beer, why they might be happening and where they might be going. And, of course, I’ll be profiling beers that I come across as they arrive here at Arrowine, or in my travels, which are notably fewer and further between these days — again, I’m a dad now.

Also, when available, I’ll be jumping back into the comments with you all. Feel free to ask non-cheese-cutting-related questions and I’ll do my best to answer them.

While Arlington shivers in its coldest temperatures in a decade, home buyers are warmed up and ratifying contracts.

The cold didn’t stop 45 buyers from purchasing homes this week. But home sellers seemed intimidated, listing only 39 properties. This does not help our problem of low inventory. Arlington currently has only 197 homes actively for sale.

At the current rate of absorption, that’s only 1.1 months of supply. This is the lowest level of inventory I have witnessed since the crazy days of 2004. We should start to see this kind of pressure pushing prices higher which is not good news for buyers.

But the Federal Reserve this week delivered some good news that it will hold off raising the short-term bank rate until further notice. That gave Wall Street a bump, lowered yields on U.S. Treasuries and pushed mortgage rates down a few basis points to about 4.5% for a 30-yr fixed rate.

The Fed said it wasn’t as concerned about inflation but is watching “global economic developments.” It lowered its assessment of U.S. economic growth from “strong” to “solid.”
