With the new Biden Administration beginning in January, 2021 it is important to look at the issue of who can qualify to hold a position in the new Administration.

For several years (e.g. Bush 1, Clinton, Bush 2, Obama) there has been a consistent security clearance process in place for individuals to hold White House positions. Our Law Firm has represented individuals in the White House in the security clearance process.

Clearance Review for White House Position

For White House appointments, they will be required to undergo a security clearance review. For these types of positions, the Federal Bureau of Investigation (FBI) has been designated to conduct security clearance investigations. The individual will be asked to complete a SF-86 form (also known as e-QIP) to begin their clearance review. Once the initial forms are completed and reviewed, the individual will be interviewed by FBI investigators and a security clearance investigation will begin.

An applicant can expect a full and complete investigation by the FBI. Friends and relatives of an applicant will be interviewed, foreign contacts will be reviewed and background information will be examined. The FBI’s goal in investigating an applicant for a White House position is to attempt to determine whether they might be susceptible to any sort of influence or blackmail that might cause them to disclose classified information.

The applicant’s full background investigation will then be given to the personnel security division of the Executive Office of the President (EOP), which handles security clearance decisions. These are career officials that oversee the security clearance process. Once received, they will review the FBI investigation and make their determination as to whether or not a security clearance should be granted. The EOP decision will generally be controlling absent further action by the President.

Decision on Security Clearances for White House Employees or Appointees

While a President retains the ultimate say as to whether or not to grant an individual’s security clearance, they have usually deferred (for the most part) to clearance recommendations. There is a good reason for this. Most presidents do not want to be seen as showing favoritism towards an individual with security risks for important appointments.

For this level of appointment, if an individual’s clearance is denied, they are unlikely to be able to hold their position. In contrast to other federal agencies, White House appointees have less access to due process in contesting security clearance determinations.

While politics can play a role in allowing an appointee the ability to respond to negative clearance concerns with mitigating information, there is less of an entitlement to due process given that White House appointees serve at the pleasure of the President. This is different than the situation with career employees of the EOP that are able to respond to security clearance concerns and receive the ability to respond to adverse clearance determinations.

Just Listed highlights Arlington properties that just came on the market within the past week. This feature is written and sponsored by Andors Real Estate Group.

A common question from buyers and sellers alike this time of year has to do with the seasonality of the housing market: “Do prices go down in the winter?”

The answer is “no,” and in fact there are a number of reasons why they continue to increase instead. For buyers, the cooler months can bring a bit of reprieve in terms of fewer price escalations, but that is tempered with potentially less to choose from. This is actually an advantageous time for sellers, though, because sellers will usually have less competition in other homes currently on the market.

Remember: This year is going to be an anomaly. We have over 200 percent more inventory going into the colder months than we did last year, though it’s pretty much all hold-over condo inventory. I’m still waiting for that part of our market to hiccup and be absorbed. I won’t hold my breath…

Our market is very much non-seasonal, especially when compared to other parts of the country. In a small town, perhaps near a military base, people pretty much only buy and sell between March and June — maybe July — based on military PCS orders. In Arlington on the other hand, people need to buy and sell 365 days a year. (Yes, I’ve actually written a contract the past four years in a row on Christmas Day!) The broad-based local economy of public, private, military, government and others create constant demand.

Here’s another example: The school-year cycle. While many people wait until the end of the school year to move — perhaps to keep kids in their routine or not change school districts mid-year — you either subscribe to the school calendar, or you don’t. There is no in-between. In Arlington, plenty of folks are on the school calendar — and even more aren’t.

This past week in Arlington, sellers listed some 63 properties for sale while buyers ratified 58 contracts; 18 of the ratified contracts were on homes listed just within the past week.

There are currently 555 homes for sale in Arlington, one more than last week: 132 are detached homes, 53 are townhouses/semi-detached and 370 are condos.

Average days on market (DOM) for currently available homes is 56, and median DOM is 41. Both of these are creeping up a bit as we head deeper into fall, and that is not unexpected. While plenty of real estate will be transacted in the cooler months, the urgency slows a bit.

Side note: Average DOM this week last year was 80, so we’ve got a way to go before we’ve “slowed” down to last year’s pace…

The median list price of currently available properties is $530,000, while the average is $750,008.

Last year for the same week, sellers listed 43 homes and buyers ratified 43 contracts. With 63 homes and 68 contracts this week, we’re still outpacing last year substantially across most metrics.

Joseph Robinette Biden Jr. will be the 46th President of the United States. What’s next for immigration? We’re here with a few careful, hedging predictions.

There are four major ways a Biden presidency will influence immigration policy: exercising the power of prosecutorial discretion, executive orders, promulgation of regulation through various federal agencies, and supporting (or refusing to support) legislation from Congress.

Prosecutorial Discretion

During the Obama Administration, the Department of Homeland Security concentrated its finite immigration enforcement resources on criminals, recent border crossers and people who posed a threat to public safety. The Trump administration took the opposite approach, by broadening its enforcement focus to embrace nearly all undocumented migrants, and by attempting to add enforcement capacity at the same time.

We predict that the focus will change, but that the increased enforcement capacity remain. This means that even with a narrower prosecutorial target, the deportation numbers are unlikely to decrease in the medium term — whether Biden follows through on his campaign promise of a 100-day moratorium on deportations or not.

Executive Orders

We believe that President Biden is likely to announce the rescission of the travel bans imposed during the Trump administration. The Supreme Court stepped in to stop the rescission of DACA, but we think that the Court is unlikely to act to preserve the Travel Bans, because the Travel Ban orders did not confer any government benefits; in fact, they did the exact opposite. The Supreme Court upheld the latest iteration of the travel ban as a legitimate exercise of Presidential power, and we expect that it would treat a rescission in the same way.

Regulatory Reversals

We also expect the Biden Administration to reverse or refuse to defend various federal regulations imposed during the Trump presidency. As our loyal ARLnow readers know, the Public Charge rule has been hotly contested in federal court. We expect that if litigation is still ongoing when Biden takes office, the Biden administration will refuse to defend new public charge rule, and so the rule will revert to its pre-Trump state.

Another regulation that has been contested and is currently enjoined is the USCIS fee increase. This is an area where we don’t expect a total reversal; we do expect some moderate fee increases to go into effect. Whether those increase will be as huge as those proposed by the Trump Administration is an open question.

We also expect the Biden administration to rescind a proposed rule that would prevent H-4 visa holders from obtaining employment authorization. H-4 visa holders are spouses or dependents of H-1B visa holders. After satisfying some other requirements, H-4 spouses may apply for employment authorization. A Biden administration is likely to rescind this proposed rule, sending things back to the status quo of the Obama administration.

Finally, the Trump Administration has recently proposed that the H-1B lottery be replaced by a strange auction system in which applicants are rank-ordered by salary and then the most lucrative positions are picked first. We expect that proposal to sink without a trace in January.

Legislation

The odds of comprehensive immigration reform remain low. Neither President George W. Bush nor President Obama, despite one-party control of the legislative machinery, was able to accomplish it. What are the odds that Biden and McConnell will do better?

Our prediction for legislative reform is more modest: a legislative effort aimed at the elimination of per-country limits for employment-based visas.

Currently, all employment-based visas have yearly quotas, depending on the category and immigrant’s country of birth. These quotas have been built into our immigration system for decades, and, over time, their effects have become more pronounced. Immigrants from certain countries wait years, and sometimes decades, before they are actually eligible for permanent residency.

For example, visas are available to Indian nationals who hold advanced degrees and got in the visa line in September 2009, meaning there is currently about an 11-year wait time. Eliminating this per-country limit would get rid of the decades-long wait time while pulling talented individuals into the U.S. labor market.

This is not a new idea. Vice-President Elect Kamala Harris proposed a bill that would have eliminated the per-country limit for employment-based visas in 2019. The bill ultimately failed.

Arlington’s newest Pet of the Week is duo Daisy and Henry, 4-year-old Shar-Pei pups who love schmoozing with their Clarendon neighbors.

Here’s what Daisy and Henry had to say about their life in Arlington:

Hi Arlington! We’re Daisy and Henry, two Shar-Pei pups. We are both 4 years old and were born in Long Island but have lived with our parents in Courthouse since we were puppies.

We absolutely love everything about living in Arlington — long walks through Clarendon and saying hi to everyone, getting treats at Lululemon, hitting up Loyal Companion for our weekly cookie and dining out at Rhodeside Grill. We’ve also been lucky enough to travel around the East Coast, seeing Montreal, New York, Asheville, Charleston and even Florida. We hope to one day make it out to the West Coast. That said, we’re happy to stay home right now and think it is absolutely awesome that both of our parents don’t go to that thing called “work” anymore. That means more attention and walkies for us.

We’re also honored to be “ambassadors” of the Shar-Pei breed. When we are walking around town, we always get a lot of questions about what kind of dogs we are and what our personalities are like. Although Shar-Pei have a reputation for being standoffish or guarded, we are quite the opposite — we love meeting people and socializing. A global pandemic, nationwide social-justice campaigns and a contentious presidential election: 2020 threw three curveballs at Rosslyn-based startup Phone2Action.

“What a year, right?”

That is Jeb Ory, the founder of Phone2Action, which offers software that promotes civic engagement through mobile phones. Last week he announced that his company is acquiring fellow startup GovPredict, following 10 months of user engagement levels that his staff have never seen before.

“We have had far and away record usage of our software this year,” he said.

Ory called the acquisition of GovPredict a “natural fit” and a “game changer.”

Founded in 2015, GovPredict builds software for nonprofits, lobbying firms, campaigns and corporations. Acquiring the startup will help both companies stay ahead of trends in digital advocacy, he said.

“It became so clear that if we were to combine forces, we would be able to solve challenging problems for our clients, to help them do their jobs better, to have better policy campaigns and make better decisions,” he said.

Unlike Phone2Action, which Ory said had a very active office culture until the shutdown orders, GovPredict has a 100% remote workforce, with many staff in the D.C. area. The 1500 Wilson Blvd office will remain Phone2Action’s headquarters as it continues offering its hybrid home-office work plan to its 160 employees. The company grew by 60 with the acquisition.

Phone2Action’s software proved to be what associations, nonprofits and organizations needed to inform and “activate” people from a distance during the COVID-19 relief efforts this spring, the social-justice initiatives this summer and the election campaigns this fall.

During the week leading up to the passage of the CARES Act, Phone2Action saw 1.5 million people advocate for policies, most of them new to their clients.

When restaurants closed, the National Restaurant Association rallied industry members to share their stories with lawmakers, he said. Another client, the American Nurses Association, changed the conversation around what personal protective equipment is and how to make sure hospitals have them.

“We saw massive engagement because regular people understood how serious this is,” Ory said. “Whatever the role, they wanted to pitch in.”

Phone2Action saw another wave of engagement after the police killing of George Floyd. During the summer of social-justice campaigns and protests, nonprofits saw spikes in online and offline engagement.

This fall, more than 10 million people visited Phone2Action’s customizable “Get Out the Vote” centers. One client, Headcount, ran celebrity-promoted voter registration drives that saw hundreds of thousands of new voters register.

“It’s been exciting and humbling to be a part of,” Ory said. “These issues are life-and-death for so many people.”

The pandemic has also changed Phone2Action’s work culture for the better, he said. With some employees fully remote before the pandemic, and others in the office full-time, the company has had a chance to evaluate what each worker needs to succeed, without priority being given to those who happened to be in the office.

“I think it’s important to acknowledge how fortunate we are to” be able to work remotely, he said.

Gravelly Point Park

If you are looking for a truly unique picnic setting, look no further than Gravelly Point Park. Located just north of Reagan Airport along the George Washington Parkway, this bankside green space is perfect for picnickers.

The main runway at Reagan (known as Runway 1/19, in case you’re interested) points directly towards the park. This means that planes using these runways soar directly over the heads of onlookers, often as low as just a couple hundred feet in the air. Because Gravelly Point is less than 1,000 feet from the end of the runway, it is one of the most stunning spots for airplane spotters in the entire country.

Getting to Gravelly Point

Unlike many other green spaces in Northern Virginia, it can be a bit tricky to take your car to Gravelly Point Park. Although the picnic space is located along the George Washington Parkway, parking is somewhat limited.

One alternative to parking and walking is to bike to Gravelly Point using the Mount Vernon Trail!

Gateway Park

With its views of Washington, D.C. and gorgeous, cultivated green areas, Gateway Park is another of our favorite places for a picnic in Arlington. This park is located in the Rosslyn neighborhood of Arlington and features 3 acres of beauty, both natural and manmade.

Gateway might not sit directly on the Potomac, but visitors can still enjoy a breathtaking vantage of the river and Georgetown, the popular D.C. neighborhood, from Gateway Park’s Skywalk.

In addition to being a great place to lay out a prepared meal, Gateway Park hosts a lot of events to enjoy. The amphitheater at Gateway Park is home to the Rosslyn Jazz Fest. Currently, the park is hosting its O2 (Office Outside) program. This allows locals to get a taste of the outdoors while still taking care of business with open-air desks and complimentary WiFi!

Getting to Gateway Park

The Arlington picnic space is located at 1300 Lee Highway, right at the base of Key Bridge. Please note that parking in the area can be somewhat limited, so you might have to park farther away and walk.

As an alternative, you can easily access Gateway via the Rosslyn Metro Station. The park is just a short walk from the Metro stop.

Dark Star Park 

In terms of basking in planned, artistic beauty, there aren’t many things to do in Arlington that rival Dark Star Park. This green space/art installation was originally built in 1984, designed and overseen by the famous sculptor Nancy Holt.

Once per year, on August 1, the natural shadows cast by the Dark Stars line up with these pre-set markings at exactly 9:32 a.m. Holt chose August 1 to commemorate the anniversary of William Ross’s 1860 purchase of the land that became Rosslyn.

But the question remains — how is Dark Star Park as a picnic spot?

In a word: lovely. Dark Star Park offers a welcome respite from the urban environment of Rosslyn, with shrubbery and grass that are a vibrant contrast to the sea of glass and concrete that marks much of the Arlington neighborhood. Large trees ring the park, providing a pleasant shade to enjoy your spread of food and drink.

Getting to Dark Star Park

Dark Star Park stands at 1655 North Fort Myer Drive in Arlington, sandwiched between Fort Myer Drive and N. Lynn Street. There are 2 separate parking garages immediately adjacent to the park, so getting to Dark Star by car is convenient. Otherwise, the Rosslyn Metro stop is only a few blocks away, for those who prefer taking the train.

There are a ton of great places to enjoy a picnic when living in Arlington — in fact, far too many to cover in a single article.
