As its police force shrinks, the Arlington County Police Department is leaning on state police when extra officers are needed to maintain its nightlife detail.

Virginia State Police troopers will be helping Arlington fill staffing holes in the local nightlife team that works with bars and restaurants in Clarendon and Crystal City to keep establishments and patrons safe and to help keep order when things get out of hand.

The number of acting police officers available to staff ACPD’s various divisions has dropped amid retirements, reports of low morale, and attrition to more lucrative and less demanding private-industry jobs. In response, ACPD has turned to VSP troopers who are willing to help out with the nightlife detail, according to the county.

This past weekend the County Board approved a mutual aid agreement between the two forces that codifies compensation for troopers.

The agreement will help keep staffing for the detail steady, not add to it, ACPD spokeswoman Ashley Savage tells ARLnow.

“The overall staffing for the Nightlife detail is remaining the same,” she said via email, adding that ACPD does not disclose the specific number of officers. “The MOU with [VSP] provides ACPD the option of utilizing troopers to fill vacancies in the Nightlife detail, when necessary. The department began exploring additional staffing resources for the Nightlife detail in September 2021 due to a reduction in ACPD’s functional staffing.”

As part of the memorandum, troopers will be reimbursed at an overtime rate for their hours worked as well as for vehicle mileage. The county will also pay a 10% fee to VSP for “administrative and accounting costs associated with the provided services,” the report said.

The detail patrols spots in Clarendon and Crystal City as part of the Arlington Restaurant Initiative (ARI), which was founded in 2016 to tackle alcohol-related crimes in Clarendon and has since expanded to Crystal City.

Through ARI — in which police patrol area bars, train employees and meet with businesses — Clarendon’s crime rates have dropped, according to the county. The detail also looks out for misbehaving bar patrons, who can be banned from all establishments that participate in Arlington’s Bar Safe program as a result of public drunkenness or more serious crimes.

Between January and September, there have been 32 Bar Safe violations, according to Arlington police data. Rates peaked in the summer, when bars fully reopened, as did the number of fake IDs. The detail confiscated 572 fake IDs during the same time period.

While many alcohol-related crimes dropped from 2019 to 2020 due to COVID-related business closures, the detail has noticed the nightlife crowd increasing every month since the state reopened, according to a monthly police report.

With that, new safety problems have arisen: last month, there were six reports of spiked drink in Clarendon and Crystal City bars.

The collaboration between ACPD and VSP was not the only agreement that received County Board approval. On Saturday, the Board approved a mutual aid agreement with U.S. Capitol Police after 50 Arlington officers helped secure the U.S. Capitol building during the “Justice for J6” rally this fall.

The rally on Sept. 18. was held in support of those charged after the Jan. 6 invasion of the Capitol by a large pro-Trump mob. It was widely reported as a flop that did not draw the expected crowds while still costing government agencies hundreds of thousands of dollars.

The county says both of these mutual aid agreements exemplify ACPD’s commitment to regional partnerships.

“The Police Department is an active member, throughout the region, in providing mutual aid assistance,” a county staff report said. “This effort allows for the appropriate utilization of resources both within and outside of the County. Our commitment to regional partnerships greatly enhances the safety and well-being of the citizenry.”

The state’s idea to lower elevated segments of Route 1 through Crystal City could cause more injuries to pedestrians and chronic congestion, according to a new report.

This summer, the Virginia Department of Transportation officially decided to turn Route 1, which is elevated over 12th, 15th and 18th Streets S., into an at-grade urban boulevard. It would feature wide buffered sidewalks on both sides, six to seven narrowed travel lanes, a 30-mph speed limit, wide crosswalks, landscaping and medians with pedestrian refuges.

The changes, which could cost $180 million, are aimed at making the corridor more pedestrian-friendly, but that may not actually be the case, according to the VDOT-commissioned report. Using Arlington County rush hour traffic forecasts, the report predicts pedestrian-involved crashes could increase.

Meanwhile, travel times could lengthen by up to 6 minutes for vehicles heading into Crystal City in the morning and heading out in the afternoon, due largely to delays for drivers turning left on Route 1 and several commuter bus stops getting rerouted.

Arlington County staff questioned how these negatives could square with VDOT’s preference for the concept, per a staff report. They suggested that the authors make the negative results of the traffic analysis clearer.

“An at-grade Route 1 has many operational challenges,” county staff said. “The short block lengths between parallel streets result in the need to coordinate signals and thus, the pedestrian delays will be increased on the minor parallel routes. The results point to negative impacts on the ability of transit to effectively serve the National Landing area. The at-grade scenario shown in the preferred alternative offers a more limited network connectivity while simultaneously introducing conflicts and sacrificing transit mobility.”

The report, prepared by engineering consulting firm Kimley-Horn, specifically recommends one at-grade option that allows all turns at 15th Street S., eliminates left turns at 18th Street S., and possibly includes a pedestrian underpass or overpass at 18th Street.

The state initially agreed to the study and changes to Route 1 as part of its 2018 agreement with Amazon to invest in transportation in the region.

Pedestrian safety 

As progress ramped up on the study, locals and organizations following the Route 1 project have kept pedestrian safety front and center.

When VDOT initially considered a nine-lane highway, advocates said that would be unsafe for pedestrians and the National Landing Business Improvement District (BID) created its own renderings for a tree-lined and pedestrian-friendly Route 1.

After VDOT revised its proposal and announced its intention to bring Route 1 at-grade, Livability 22202 — a coalition of three area civic associations — rejected the study for several reasons, chief among them that even the new six- to seven-lane highway would not, in their view, improve pedestrian safety.

Data in the report appears to bear that conclusion out. Over two decades, pedestrian traffic during peak afternoon hours could increase 2x to 5x current levels, and with that could come more crashes involving pedestrians.

(Updated, 11/16) Long-time local restaurant Pines of Florence — and its owner — are each making an unlikely comeback.

The Southern Italian eatery will once again be cooking, this time in Arlington’s Cherrydale neighborhood, after stints in Virginia Square, Columbia Pike, and Old Town Alexandria, owner Jimmy Khan confirms to ARLnow. It’s coming to 2109 N. Pollard Street, the space formerly occupied by the recently-closed Portabellos restaurant, in a one-story shopping strip just off of Langston Blvd.

The plan is to have a “soft opening” this Saturday, Nov. 20, says Khan, where customers can bring their own beer and wine (there will be a service fee).  Khan expects to have their liquor license in about two weeks and will have a “grand opening” then.

The opening comes a year and a half after Khan suffered through a protracted and nearly fatal battle with COVID-19.

“I had a 6% chance of living,” he tells ARLnow. “I was on a ventilator for 40 days. The doctors say it was a miracle I lived.”

During that time and his recovery, he took a long look at his life and decided he needed to do more for his family. That’s why he decided to reopen Pines of Florence.

“God gave me another life, so I wanted to do something for my kids, the next generation,” says Khan.

Pines of Florence’s last location was on King Street in Alexandria in a building that was set for redevelopment. While that was a big reason the restaurant shuttered in June 2020, the closing was also related to Khan’s own battle with COVID and his co-owner (and uncle) retiring.

After some time away, Khan is ready for a restart.

“Being a restaurant owner is in my genes,” he said. “I quit for a while, but I’m re-energized.”

Khan says the plan is to open even more restaurants in the coming years.

The new Pines of Florence will, like the previous iterations, serve pizza, sandwiches, and homemade pasta dishes, as well as beer and wine. It will replace Portabellos: An American Cafe, which closed just this past September, after 15 years serving the Cherrydale and Maywood communities.

Khan says he stands by his June 2020 words about wanting to do more for his community, including creating jobs and helping those less fortunate, particularly after his near-death experience.

“[This restaurant] is going to be meaningful for my family and the community,” he says. “I want to help.”

The speed limit is being lowered in some local roads.

The Arlington County Board voted 5-0 on Saturday to approve the establishment of “School Slow Zones,” with 20 mph speed limits. Implementation, around 13 public and private schools, is expected to be complete this later winter or in the spring.

County staff will evaluate the effectiveness of the initial slow zones before moving forward with potentially implementing the lower speed limits around all Arlington schools.

Today, the Arlington County Board voted 5 to 0 to approve the creation of “School Slow Zones,” which aims to reduce traffic speeds around 13 schools across the County. The zones address a key action item in the Vision Zero Action Plan, adopted by the Board in May, and are the first application of permanent 20-mile-per-hour speed limits permitted under Virginia law.

Schools are a key focus area for Vision Zero in Arlington – a nationally recognized strategy to eliminate all fatalities and severe injuries no matter the means of travel, while increasing safety and mobility. Some specific data points:

  • One in four crashes in Arlington involves speeding.
  • Every year, there are 10+ crashes involving speeding around schools in Arlington.
  • The risk of injuries and deaths increases as vehicle speeds increase.
  • Children are among the most vulnerable travelers.

The School Slow Zones are the result of an interdepartmental partnership between the Arlington Department of Environmental Services’ Transportation Division, Arlington Public Schools (APS) and the Arlington County Police Department.

“The recent tragic traffic fatalities in our community remind us how important it is to achieve our Vision Zero goal of eliminating serious traffic injuries and deaths,” said Arlington County Board Chair Matt de Ferranti. “These zones are one of many steps the County is taking to help road users reduce speed and increase awareness of people – usually children — walking and biking near our schools.”

What are School Slow Zones?

A School Slow Zone is a permanent 20 mile-per-hour speed limit on a neighborhood street within 600 feet of an access point to a school. Speed limit signs and pavement markings clearly define the zone.

Where will the First Slow Zones Be Located?

This demonstration project approved by the Board will install 11 School Slow Zones around 13 public and private schools in the County (two zones both include pairs of schools very near to each other), to test the effectiveness of the treatments developed by transportation staff. County and APS staff identified schools for the demonstration project from three different sources:

    • Hoffman-Boston Elementary School
    • Gunston Middle School
    • Drew Elementary School
  • In coordination with APS

Implementing School Slow Zones

Implementation of the first Slow Zones is expected to take between three and five months.

During the demonstration stage, transportation staff will collect “before” and “after” vehicle speed data to assess whether zones, as designed, successfully reduce speeds around schools. Transportation staff will also collect public feedback before considering adjustments to zone infrastructure and placement for all remaining schools in Arlington.

Moving forward, the County anticipates adding ten Slow Zones each year, meaning that the 40-plus public and private schools in the County could be updated within the next three to five years.

A shot was fired during a dispute in the parking lot of a 7-Eleven store on Columbia Pike last night.

The gunfire rang out around 6:45 p.m. on the 3600 block of Columbia Pike. Police say a man drew a gun during a dispute with another man and then fired a shot, though the gun might have been fired accidentally.

Police swarmed the store, placing crime scene tape around the entire parking lot as they investigated. No one was hurt, police said.

Police are describing the incident as “reckless handling of [a] firearm.” So far there’s no word on any arrests.

“At approximately 6:42 p.m. on November 11, police were dispatched to the report of a person with a gun,” said Arlington County police spokeswoman Ashley Savage. “Upon arrival, it was determined that two male subjects became involved in a dispute in the parking lot of a business. One subject produced a firearm and the firearm was discharged during the incident. The circumstances of the discharge remain under investigation. No injuries were reported. The investigation is ongoing.”

Advanced Towing truck in Clarendon

(Updated, 10:35 p.m.) The Arlington Circuit Court finally came to a decision in Virginia Attorney General Mark Herring’s lawsuit against Advanced Towing after last month’s multi-day trial.

The court has ordered the towing company, whose tactics have angered many in Arlington, to pay a civil penalty of just $750 for five separate violations. That’s a far cry from the $650,900 that the Attorney General’s office was seeking at trial.

“Although the Defendant’s conduct is sanctionable, the Court is constrained by the remedies available in both the Virginia and Arlington County Code,” wrote Judge William Newman in an opinion letter sent to both sides late Wednesday afternoon.

Additionally, the court did not issue an injunction against the towing company, writing that while there were “deficiencies” in Advanced Towing’s business practices and record keeping, the court “does not find evidence to issue a permanent injunction against Defendant.”

Chap Petersen, Advanced Towing’s attorney — as well as a Virginia state Senator — said at trial that he believed “the office of the Attorney General wants to put my client out of business.” He said the ruling largely vindicates the company and owner John O’Neill.

“While disappointed that the Court made any findings against our client, we feel vindicated in that the Court only assessed a $750 fine for the [five] found violations,” writes Petersen in a statement to ARLnow.

The court assessed one $150 civil penalty for not safely securing consumer vehicles with straps, one $150 civil penalty for not updating contract changes for a commercial parking lot in Ballston, and three $150 civil penalties for employing three drivers that were not registered with the Virginia Department of Criminal Justice Services (DCJS).

During the trial, the AG’s office, represented by Assistant Attorney General Erin Witte, called Advanced Towing’s practices “predatory, illegal, and dangerous.” To prove this, they called up a parade of witnesses, including Arlington County police officers and drivers who had their cars towed.

The court found merit in only some of the Attorney General’s claims.

The AG’s office argued that Advanced Towing didn’t clearly mark parking spaces at the Ballston lot, near Gold’s Gym on Wilson Blvd, leaving consumers confused. However, the court ruled the spots were properly labeled and signs properly posted and, therefore, didn’t assess a civil penalty.

Additionally, the AG’s office claimed that Advanced Towing didn’t have copies of towing contracts available for public inspection. But the court ruled that the relevant contracts were available to the public and, also, didn’t assess a civil penalty for that.

“Advanced Towing has been found to have violated the law and it’s time for the company to clean up its act. I am disappointed that the Court only awarded $750 in civil penalties and did not award restitution to consumers, especially the victims of Advanced’s dangerous towing practices who voluntarily testified in court to tell their story,” Virginia Attorney General Mark Herring wrote in a statement to ARLnow. “Advanced Towing has employed predatory and illegal towing practices for years, costing Virginia consumers hundreds, if not thousands of dollars, and it deserves to be held accountable for its actions. I am proud of the hard work my Consumer Protection Section has done on this case, and we will not stop going after bad actors who prey on Virginians just trying to go about their daily lives.”

Petersen noted that, before the trial, the Attorney General’s office offered to settle the case over the summer for $780,000 and an injunction against certain practices by the company.

“I think the difference between the AG’s offer and the Court’s decision speaks for itself,” he said.

While it remains possible that the Attorney General could appeal the ruling, Herring lost his bid for a third term last week, putting further action in the case into question.

A final decree is scheduled to be presented to both sides in court on December 10.


(Updated at 4:15 p.m.) Arlington police and firefighters are on scene of a fatal crash involving a motorcyclist and a school bus with children on board.

The crash happened around 2:45 p.m. on S. Kenmore Street in front of Drew Elementary, in the Green Valley neighborhood.

A school bus with 14 students on board struck a man who was riding a motorcycle, according to police. The man, who was reportedly wearing a helmet, was found lying unresponsive in the roadway.

Police have closed S. Kenmore Street, likely for an extended period of time while detectives investigate the crash. The victim remains in the roadway, covered in a white sheet, while police tape has been placed around the crash site.

School counselors are being requested to the scene for the children who were on board the bus at the time of the crash. No physical injuries were reported among the students, who have since been taken off the bus.

Despite the location of the crash, we’re told that that bus came from a school other than Drew.

Witnesses, some of whom were sobbing as they spoke to ARLnow, said the motorcyclist was someone they saw often in the neighborhood. They said he had just driven out of an alley at a high rate of speed and tried to lay down his motorcycle when he saw the bus coming. He “went flying” and was run over by the bus, witnesses said.

The man’s injuries were such that first responders immediately radioed that he was deceased after arriving at the scene and failing to find a pulse.

Neighbors said that numerous kids and adults witnessed the crash, which happened in a busy area next to a park on a sunny, warm autumn day.

The neighbors who spoke to ARLnow said that the deceased man was in his early 20s and worked at a nearby auto rental and repair shop.

“They are good guys,” a neighbor said of the workers at the family-owned shop.

Update on 11/11/21: Arlington County police just issued the following press release about the fatal crash.

The Arlington County Police Department is investigating a fatal motorcycle crash that occurred on the afternoon of November 10, 2021.

At approximately 2:49 p.m., police were dispatched to the 3500 block of 23rd Street S. for the report of a vehicle crash with injuries involving a school bus and motorcycle. Upon arrival, officers located the unresponsive motorcyclist partially under the school bus. He had succumbed to his injuries and was pronounced deceased on scene. The school bus had fourteen students onboard at the time of the crash. The students safely exited the bus, were evaluated by medics and no additional injuries were reported.

The preliminary investigation indicates the motorcyclist was traveling at a high rate of speed from an alley on 23rd Street S. onto S. Kenmore Street. He tried to avoid the oncoming school bus by laying down the motorcycle and ultimately ended up partially under the bus. The deceased has been identified as Stevan Zikic, 26, of Alexandria, VA.

After Republican victories in Virginia last Tuesday, Arlington’s Democratic state legislators say their focus is preserving policy gains they made over the last few years.

Last week, Virginians elected Glenn Youngkin as Governor, Winsome Sears as Lieutenant Governor and Jason Miyares as Attorney General. Despite a slight shift right, Arlington overwhelmingly elected and re-elected all Democrat lawmakers.

Control of the Virginia House of Delegates also appears to shifting to the GOP, pending the outcome of two potential recounts.

“My top priorities are defense, defense and defense,” Rep. Rip Sullivan (D-48) told County Board members yesterday afternoon. “In light of last Tuesday, there are a lot of things that I’ll be interested in making sure we can preserve, in terms of things that have been accomplished over the last couple of years.”

County Board members met Tuesday with state lawmakers to outline the Board’s priorities for the upcoming legislative session — such as vehicle noise enforcement and virtual government meetings — and hear what legislators are focused on.

Among House representatives and state senators, there was an emphasis on preserving work done under outgoing Gov. Ralph Northam.

“In terms of playing defense, as whip for the House Democratic caucus, we are going to be incredibly vigilant in making sure that all of the progress we’ve made [is] not whittled away at the 11th hour, 59th minute, at 7 a.m. subcommittee meetings — that we are casting a very bright light on all the actions taken on the House floor so there’s a very clear record at the end of this long session that people know what they voted for,” said Del. Alfonso Lopez (D-49).

Looking to inject some optimism into the conversation, Board Member Christian Dorsey asked what areas could see bipartisan support. Legislators predicted bridging the aisle to reduce medical debt, expand broadband access, support small businesses, incentivize community college for in-demand jobs, fund mental health services and increase teacher pay.

More locally, the County Board and their state representatives had a number of overlapping priorities: allowing electronic meetings post-pandemic; improving access to childcare; firming up the rights of affordable housing tenants; and committing to environmental sustainability initiatives and teacher pay raises.

Top of mind for County Board members, however, is what they describe as an ongoing behavioral health crisis caused by the closure of most state psychiatric hospitals this summer and exacerbated by police and mental health services workforce shortages. The Board and county staff made the case for more state funding for community-based mental health services.

“This is very time sensitive and very important as we try to serve those most in need in Arlington,” Board Chair Matt de Ferranti said.

Without sufficient state beds to which to bring people in crisis, police have to detain people against their will in emergency rooms for multiple days while staff in the Department of Human Services make calls around the clock, searching for beds.

“They have no privacy, they’re in police custody day after day,” Arlington County Police Department Capt. Michael Rowling said. “I can’t imagine they’re getting better — they’re not getting treatment whatsoever.”

On a daily basis there are five to 10 individuals attended by police officers in the emergency department of Virginia Hospital Center waiting for a mental health bed, Human Services Deputy Director Deborah Warren said.

“It’s inhumane,” she said. “On the worst day of their lives, [people in crisis] are handcuffed to a gurney, under police supervision, agitated and maybe getting sedation.”
