After years of delays, plans for half of an undeveloped parcel of land in Potomac Yard, called Land Bay C East, are taking shape.

Two residential buildings with ground-floor retail, bisected by a pedestrian pathway, are planned along Potomac Avenue and Crystal Drive between 29th Street S. and 33rd Street S. In addition to 488 residential units, the plans call for underground parking and open space.

The developer, ZOM Living, has dubbed the project Hazel National Landing. A luxury apartment developer with an office in Tysons, ZOM Living has built The Beacon Clarendon on N. Irving Street and 19Nineteen in Courthouse.

The plans are a long time in coming for the parcel, which is currently used for parking and as a construction staging area, said Adam Watson, a County planner, in a staff presentation from December.

“Despite persistent leasing efforts, the property remains vacant,” said Martin “Art” Walsh, the attorney for the project, said in ZOM Living’s presentation from December. “We’ve worked with economic development to verify our efforts in terms of trying to lease the property.”

The original site plan was approved in 2007 and situated four office buildings over an underground parking garage. It allotted more than 1 million square feet to office space, 41,000 square feet for retail space, as well as a half-acre for a park.

The land is owned by German grocery chain Lidl, which has its U.S. headquarters nearby. In 2017, the County Board gave Lidl a three-year extension to develop the property.

In February 2020, six months before the three-year extension ended, Meridian Development Group seemed poised to swap offices with residential buildings. Two months later, ZOM Living submitted its plans.

ZOM Living’s development covers Land Bay C East, while the western half is still slated for offices.

The first residential building will be 150 feet tall, with 14 floors and 297 residential units. The second building will be 120 feet tall, with 11 floors and 191 units. The towers share 9,181 square feet in retail space and two floors of below-grade parking, with 399 residential spots and 15 retail spots.

Some of the lower-level units will have their own townhouse-style exterior entrances.

Renderings illustrate primarily brick buildings with large patios and greenery on the ground floor and rooftop, overlooking a tree-lined passageway and plaza.

“We’re very excited about the vibrancy and potential of this project, not only for the buildings but the public open space,” said Tom Kerwin, the founding principal of bKL Architecture, during the December presentation.

A public engagement period for the project ended in December 2020. The Site Plan Review Committee will look over the project in February and March, prior to consideration by county commissions and the County Board.

Arlington County police are investigating a carjacking that happened at one of the Riverhouse apartment buildings in Pentagon City this morning.

Police say a Hyundai with three people inside pulled up to the victim after she parked her Honda Civic. The suspects implied that they were armed, stole the woman’s car and purse, and then fled the scene, according to police department spokeswoman Ashley Savage.

CARJACKING, 2021-01220113, 1400 block of S. Joyce Street. At approximately 11:08 a.m. on January 22, police were dispatched to the report of a grand larceny auto. Upon arrival, it was determined that the victim was exiting her parked vehicle when the suspect vehicle, occupied three times, approached. The suspects implied they had a weapon and threatened the victim before stealing her vehicle and purse. The victim was not injured. The victim’s vehicle is described as a Honda Civic with Virginia plates. The suspect vehicle is described as a white Hyundai. Police remain on scene investigating.

The D.C. region is in the midst of a rash of carjackings, including violent, armed carjackings. There were 16 carjackings in Arlington in 2020, after just three were reported in the previous two years, Savage tells ARLnow.


The Arlington man accused of throwing dogs over an apartment balcony to their death would potentially not serve additional jail time under a proposed plea agreement.

The agreement, dated December 7,  is signed by the Commonwealth Attorney’s Office, but not by the defendant or by his court-appointed attorney Adam Krischer.

ARLnow reached out to Krischer about the status of the agreement, who responded via email that he has no comment. We obtained a copy of the document upon request from the Arlington County Circuit Court, after receiving an anonymous tip about the potential plea agreement.

On January 5, according to documents provided, 27-year-old Zachary changed his “not guilty” plea to “guilty” — while asserting his innocence, in what is known as an Alford plea — for the charge of animal cruelty.

(ARLnow has decided to withhold the defendant’s last name from this article, despite it being publicly reported in previous articles, due to the mental health-related matters discussed in the plea agreement.)

The judge approved the plea and set the sentencing for February 12. The judge also required the defendant to undergo a substance abuse screening prior to sentencing.

Animal cruelty is a felony offense that carries a 1-5 year prison sentence and a fine of up to $2,500. The proposed plea agreement, however, calls for defer disposition for two years, meaning the plea to the felony charge could be withdrawn and dismissed if the defendant adheres to certain conditions.

According to the agreement, those conditions include completing substance abuse evaluation and treatment, undergoing mental health evaluation and counseling, remaining medication compliant, and completing 100 hours of community service.

The defendant also has to remain drug and alcohol free, refrain from owning any animals, and not to have any unsupervised contact with animals beyond those owned by family members.

Additionally, he has to pay restitution of about $1,800, including payments to the owner of one of the dogs that was killed and $567.29 to the Animal Welfare League of Arlington.

If Zachary does all of that, the proposed plea agreement states, the Commonwealth and the defendant will jointly ask the court to withdraw the guilty plea and provide an order of dismissal. If the defendant doesn’t adhere to the above conditions, he could be sent to prison.

Commonwealth’s Attorney Parisa Dehghani-Taft was elected in 2019 to be Arlington’s top prosecutor on a platform of reform and restorative justice. In an interview with Arlington Magazine last March, Dehghani-Taft said that the concept of restorative justice is about healing and taking responsibility.

“It asks the person who did the harm to search for change and transforms them into someone who doesn’t do it again,” she said. “It focuses on rehabilitation rather than punishment.”

It’s a concept that also has gained popularity in other local jurisdictions.

When asked for comment about the plea agreement, Dehghani-Taft responded via email that rules “constrains me from making public statements about pending cases… Because the court has not yet accepted any plea, it could be seen as prejudicial for me to say something now.”

In a follow-up email, she stated that “I think the terms in the document the court has published are self-explanatory.”

A statement of facts about the case entered in court describes the April 27, 2020 incident in more detail.

Police responded to a call about two dogs being thrown off a fifth floor balcony of the Meridian apartment building at 1401 N. Taft Street in Courthouse. One belonged to the defendant and the other to his roommate. Both dogs were brought to veterinary facilities and later died from their injuries.

Zachary was detained without incident, but told the officers that he was diagnosed with anxiety and had not been taking his medication. He also said that he had recently smoked marijuana.

The reason for his actions, he told police, was that he wanted to repair his relationship with his roommate and felt the only way to do that was to kill the dogs.

Police spoke to the roommate and Zachary’s boyfriend, who both described the defendant as not acting like his normal self over the prior several days and possibly having a severe mental health crisis at the time.

The Virginia General Assembly, America’s oldest continuous law-making body, is currently convening and local lawmakers are introducing a slew of new legislation.

While a number of these bills will eventually fail, unable to pass committees or the full General Assembly, a few of these proposals may ultimately become state law. And the odds are much greater than prior years.

Every one of Arlington’s state lawmakers are Democrats, and after years in the legislative minority Democrats currently hold the Virginia House of Delegates, the Virginia State Senate, and the Governorship.

Here are a few of the notable bills being proposed by Arlington lawmakers:

  • HB 2164: Introduced by Del. Patrick Hope (47th District), the bill would reinforce the July 2019 law that no one under the age of 21 can purchase tobacco products by further defining them as nicotine vapor products or alternative nicotine products. It would also take away the expectation that those in active duty military but under 21 can purchase tobacco, and would disallow the selling of tobacco products from vending machines. It’s currently awaiting a vote in the General Laws Committee.
  • HB 1854: Proposed by Del. Richard “Rip” Sullivan (48th District), this bill would grant Arlington County the ability to rename the section of Route 29 — currently called “Lee Highway” — that lies within the county’s boundaries. In December, a local task force recommended renaming the road to “Loving Avenue.” The bill is currently awaiting a vote in the Transportation Committee.
  • SB 1159: Proposed by Sen. Barbara Favola (District 31), the bill would allow sick leave to be used to care for an immediate family member. The law would apply for all employers that have a sick leave program and have 25 or more employees. It also only applies to those employees who work more than 30 hours and leave is limited to five days per calendar year. It’s currently awaiting a vote in the Commerce and Labor Committee.
  • SB 1382: Also introduced by Sen. Favola, this bill would prohibit the purchase, possession, or transportation of a firearm by anyone who has been convicted of assault and battery of a family or household member. It’s currently awaiting a vote in the Judiciary Committee.
  • HJ 557: The proposal from Del. Alfonso Lopez (49th District) would repeal the 2006 Virginia constitutional amendment that defines marriage as “only a union between one man and one woman.” It would also no longer prohibit the Commonwealth from recognizing the legal status of “relationships of unmarried individuals that intends to approximate… marriage.” In 2014, the U.S. Supreme Court ruled that Virginia’s ban on same-sex marriage was unconstitutional, so essentially this proposal would codify and bring the Virginia Constitution up to date. It’s currently awaiting a vote in the Privileges and Elections Committee.

The County Board is slated to accept nearly $118,000 in state funding that would reimburse the County for bonuses to sworn officers in Arlington County Sheriff’s Office.

On Christmas Eve, 222 Sheriff’s Office personnel each received a $500 bonus, after an amendment to the Commonwealth’s 2021 budget passed during a special session last year, according to a county staff report. The bonuses are not intended as a replacement for hazard pay during the pandemic, the report notes.

The full amendment awards $18.4 million in one-time bonus payments to Virginia’s sheriffs, deputies, superintendents and regional jail officers.

The bonuses from the state Compensation Board came in lieu of salary increases, Arlington County Sheriff Beth Arthur said.

Arthur said she works with the Virginia Sheriffs’ Association, which advocates sworn officers in the Commonwealth. In Arlington, she said the County heavily subsidizes salaries, but that is not true throughout the state.

“It’s a constant issue at the top of our agenda,” said Arthur, a former association president. She said that while she was happy to give her officers financial assistance, these bonuses do not go as far as salary increases would for those in other jurisdictions receiving little to no local subsidies.

The sum also includes insurance contribution expenses for January, the county report noted.

The Board is scheduled to review the County Manager’s recommendation to accept the funding during its regular meeting on Saturday.

In Arlington, Sheriff’s deputies staff the county jail, provide security to courtrooms, assist with traffic enforcement, and serve court notices, among other law enforcement duties.

A teenager with a concealed handgun was taken into custody at the Fashion Centre at Pentagon City mall yesterday afternoon.

The arrest does not appear to have a direct connection to the inauguration, though it took place on Inauguration Day as police were on high alert for possible security threats.

An officer in an unmarked cruiser spotted the teen tucking a gun into his waistband as he entered the mall with four other juvenile suspects, according to an Arlington County Police Department crime report and scanner traffic. The officer then called for backup, and police were able to arrest the teen in the vicinity of the food court.

WEAPONS VIOLATION, 2021-01200100, 1100 block of S. Hayes Street. At approximately 2:00 p.m. on January 20, an officer observed five juvenile subjects pass their cruiser and then stop a short distance away, at which point they observed one of the subjects readjusting a firearm in their waistband and then conceal it under clothing. The subjects entered a business and dispersed, however police subsequently located the subject with the firearm a few minutes later and made contact with him. They confirmed their status as a juvenile and located the firearm on their person. Petitions for Carrying a Concealed Weapon and Possession of a Handgun or Assault Firearm by a Juvenile were sought for the juvenile suspect.

Also in today’s crime report, two cars were stolen in the Country Club Hills neighborhood of north Arlington early Wednesday morning. Both cars were reported left outside unlocked, with keys inside.

Despite everything that transpired leading up to it, Inauguration Day saw a peaceful transfer of power as now-former President Donald Trump departed the White House and President Joe Biden was sworn in.

Overlooking it all from across the Potomac, Arlington played a bit part in pomp and circumstance.

Those with a vista across the river could catch a clear view this morning of President Trump departing the South Lawn of the White House on Marine One.

The inauguration ceremony that followed was devoid of members of the general public, as security and virus concerns closed the National Mall. Some who wanted to experience history unfold in person headed instead to the Marine Corps War Memorial, near Rosslyn.

A sizable security presence could be seen near the Rosslyn Metro station as the inauguration ceremony concluded and as President Biden and Vice President Kamala Harris — joined by former residents Clinton, Bush, Obama — headed via motorcade to Arlington National Cemetery.

Biden and Harris paid their respects at the Tomb of the Unknown Soldier before heading back into D.C., via the Memorial Bridge, for their arrival at the White House.

When Chef David Guas of Bayou Bakery in Courthouse delivered food to the security personnel in the District on Monday, it took two-and-a-half hours and many phone calls — even to D.C. Mayor Muriel Bowser — to pass each checkpoint. 

“When I arrived the Commander of that unit and the policeman literally cheered, [saying] ‘Bayou Bakery is here,'” Guas tells ARLnow.

Bayou Bakery and Arlington-founded District Taco are helping nourish the 25,000 servicemen and women, along with law enforcement, deployed to protect the nation’s capital during the 59th Inauguration.

The homegrown Mexican chain donated 2,000 burritos to the National Guard on Monday. The day before, Guas said he and his crew worked into the night to prepare biscuits and sandwich lunches for the Monday delivery.

The two join about 30 D.C.-area restaurants distributing meals to the multitudes, hailing from Maine to Guam. The heightened security is in response to the mob of Trump supporters who stormed the Capitol on Jan. 6.  

District Taco donated burritos that were pledged during a “Buy One, Give One Burrito” campaign in December.

On Monday, CEO and co-founder Osiris Hoil cashed in all 2,000 BOGO burritos to feed the National Guard. He said they were so popular that supplies ran out long before the lunch hours ended.

“When I saw the brave servicemen and women protecting the Capitol building, I knew exactly where I wanted those pledged burritos to go,” Hoil said in a press release. 

District Taco also donated hundreds of burritos to essential workers in hospitals and food banks last October and November. Hoil said he is proud to continue this longstanding tradition of giving back.

“Thanks to the support of our community, our restaurants are still open,” Hoil said. 

Guas also uses his food for good. He co-founded Chefs Feeding Families during the pandemic and has cooked for the annual awards dinner put on by Blue Star Families.

“Not having served in the military myself — but having grandparents that did — I’ve always jumped at the opportunity to help our men and women in uniform who protect our freedom,” he said.

Guas credits his involvement to Micheline Mendelsohn Luhn and Spike Mendelsohn, his friends and two of the family members behind We, The Pizza. The duo told ABC News that D.C. restaurants — despite struggles during the pandemic — are pitching in to provide fresh food to upwards of 5,000 people, who might otherwise have to rely on pre-packaged military meals, each day.

A recent national report has revealed that rents in Arlington have dropped by 14.8% since last March, according to an analysis of U.S. Census Bureau data by ApartmentList.com.

Arlington has had the seventh-largest decrease compared to other (much larger) markets, like New York, San Francisco, and Seattle. D.C. had the fifth-largest decrease.

Between December and January, Arlington rents decreased by nearly 2.5%.

The median two-bedroom rent in the county is now $2,032, according to the report. However, Arlington still has the most expensive rents in the D.C. region, topping fellow close-in suburbs like Bethesda and Alexandria.

There’s one huge reason for the drop.

“It’s really tied to the economic carnage [from] the pandemic,” says Terry Clower, director of the Center for Regional Analysis at George Mason University. “Most of the jobs that we have lost have been in the hospitality services and retail sectors, which are typically disproportionately renters.”

Clower says parsing out data shows the pandemic has also caused behavioral changes in terms of renting. In general, high-rise units have seen a larger drop in demand than lower-rise properties, Clower notes.

If part of your calculation of where you want to live at the moment is based on how dense the development is, how [crowded] it is in the elevator,” says Clower. “Then, you are less likely to live in a high rise.”

Ballston and Rosslyn, in particular, have seen an influx of these dense-living types of properties, mostly due to construction prior to the pandemic, though there are more in the pipeline.

What’s more, there’s lower desire at the moment to live in high-density areas, according to Clower. While rent prices have declined in Arlington, they’ve risen in further D.C. area ‘burbs.

“Areas like Fredericksburg, Virginia… or Charles County, Maryland, rents have increased,” says Clower. “You’re getting… that effect of fleeing the dense inner suburbs to the less dense outer suburbs.”

The need for more space, as well, has shifted some renters to exploring buying single family homes. Between a lack of housing inventory and rising home values in Arlington, says Clower, demand for residences in the outer suburbs have also exploded.

“Most households in our region are two-income earner households, especially families with school-age children,” says Clower. “Kids need a place and both [parents] need some place to work inside the house, preferably not the kitchen table.”

Plus, lower interest rates have also encouraged first-time home buyers.

While rent decreases may be good for renters, it’s not good for property owners, developers, or even the county as a whole.

Clower says smaller landlords, those that only own a few properties, are not getting any break on mortgage payments, meaning decreasing rents impact their ability to pay their mortgage. In terms of the bigger developments, units are generating less revenue.

“They are less valuable in the market, which means that… the property taxes paid to local governments should be reduced as well,” says Clower. “Because they’re less valuable and generating less income.”

Arlington County depends on these property taxes to balance its budget and provide services to residents. But the full impact of all of this may not be seen until further into the future.

“The fiscal and economic down side of this pandemic is going to last well beyond… when we start getting the pandemic under control through the vaccinations,” says Clower.

Right now, it just may be a great moment to rent in Arlington. Clower says we can probably expect a continued slight dip in rents, but the big drop-off probably has already happened with vaccinations starting to happen.

“If you are looking for a good deal and prefer to be a renter,” says Clower, “it’s probably a good time to lock in a relatively long term lease.”
