Question: Can you explain how the Earnest Money Deposit is used and what an acceptable amount is?

Answer:

What is the EMD?

I like to define Earnest Money Deposit (EMD) as an amount of money deposited by a Buyer as security for the Seller that the Buyer will perform under the obligation of the real estate contract. Assuming the Buyer completes the purchase transaction, the deposit is deducted against what they owe at closing (down payment + closing costs).

If the Buyer voids the contract within their contractual rights (e.g. Home Inspection Contingency), they receive their deposit back in full. If the Buyer defaults (cannot close or backs out without contractual protections), that money is at risk (more on this later).

In most cases, the deposit is held by the Title Company handling the transaction. They act as an unbiased administrator of the deposit and are also the ones handling the funds at closing. In some cases, one of the brokerages representing the Buyer or Seller may also hold the EMD, but this is much less common today. In either case, the handling and distribution of the deposit funds are strictly regulated to prevent co-mingling or improper distribution if the transaction falls through.

The contract also stipulates when the funds are due. In most cases, Buyers make the deposit within 3-5 days of an offer being ratified (accepted by both parties). If you’re a Buyer preparing to make an offer, I recommend making sure you have enough funds for your EMD in an account that you can easily transfer money out of (wire or check), not a brokerage or retirement fund that takes 5-10+ days for money to clear.

How Much is the EMD?

The amount of the deposit is a negotiable term in the contract and should be given serious consideration by both Buyers and Sellers. Buyers can use the deposit amount to increase the actual or perceived strength of their offer over others. In the current market where many Buyers are competing with other offers, a higher EMD can help you stand out if you’re in a tight race with another offer.

What does it mean to stand out with your EMD? In my opinion, 1% of the sale price is the lowest EMD that should be considered, but 2-3% of the sale price is appropriate in most non-competitive or lightly competitive situations. In competitive situations, it’s common to see at least a few Buyers offer EMD of 5% of the sale price or more. I’ve even seen Buyers offer to post their entire down payment as EMD.

Consider it from the perspective of a Seller. If you’re reviewing multiple great offers on a $1,000,000 home and one has a 2% EMD ($20,000) and the other has a 10% EMD ($100,000), wouldn’t you be drawn towards the offer with a substantially higher EMD?

As a Seller, other terms like price, contingencies and closing date will most likely rank higher in priority than EMD amount but it’s still important to ensure you have an acceptable deposit.

Consider this scenario… if you’re selling a $1,000,000 property and the EMD is 1% ($10,000), is that enough to keep your Buyer locked into the contract if, one week before closing, their dream home hits the market and they begin questioning the purchase of your home? Maybe yes, maybe not.

Is $10,000 enough money for you to offset the hassle and cost of going back on the market and uncertainty of getting the same or better price the second time around? Probably not.

So make sure that the deposit you’re receiving is enough to disincentivize the Buyer from defaulting and enough to offset the cost and hassle for you if the Buyer does default.

It’s no coincidence that our busiest week yet for 2021 is also the hottest! This hot weather coming will not deter buyers from frantically bidding on a piece of red-hot Arlington real estate.

Sellers listed 138 homes for sale this past week, 22 more than the week before! Purchasers came in strong, ratifying 91 contracts, 47 of which were on homes just listed in the past seven days.

This week, there are 505 available properties for sale throughout all of Arlington and across all property types — 28 more than last week. Of those, 124 are detached homes.

There are 57 townhome/semi-detached homes currently for sale, and condominiums make up 324 of the available units in Arlington.

Condominium inventory is creeping up quickly in Arlington. At the peak last year, we had 370 available condos for sale. The market absorbs them but not at a fast enough pace to help value keep pace with the detached and semi-detached/townhome units. Condos on the market right now have an average days on market (DOM) of 70, so they’re taking more than a week longer to sell than their attached/detached counterparts.

Emerald Massage Center is a woman-owned small business specializing in deep tissue, Swedish, hot stone and sports massages located in the Lyon Park neighborhood of Arlington.

“We love being in Lyon Park because it’s so charming and close to the Clarendon Metro station,” owner Amanda Silva said.

Having immigrated to the United States from Brazil at the age of 13, owning a small business has been a dream of a lifetime.

In her early twenties, Amanda became a licensed massage therapist. After working several years at various corporate massage franchises, in June 2019, Amanda decided to develop her business plan and Emerald Massage Center became a reality.

“My business partner was born and raised in Arlington and knows how great the community is,” Silva said when asked why she decided to locate her new venture in Arlington.

Like many entrepreneurs getting their business started, “I tackled everything myself,” described Silva when opening her new business — from creating the LLC to finding the commercial space, applying for permits, decorating and marketing her business.

Of course, starting a business hasn’t come without challenges, and the global pandemic has made the intimate nature of massage therapy difficult.

“My business was actually starting to take off the ground and do really well in February of 2020, only to be closed in March for nearly four months by the coronavirus,” Silva said.

Despite these challenges, Emerald Massage Center has been fortunate to have a loyal customer base, including Ruth Garvey, daughter of Libby Garvey, a member of the Arlington County Board.

“Ruth and her husband have been regular clients and have been wonderfully supportive of Emerald Massage Center,” Silva said.

Additionally, the ability to recruit talented massage therapists has been a huge added value to her business.

“Grady McGonagle’s knowledge, attention to detail and experience at five-star luxury spas in Washington, D.C. has been a great contribution to my business,” she said.

Over the next five years, Emerald Massage Center’s focus is growth with plans to remain at the same Lyon Park location.

“I really enjoy checking out the wonderful farmer’s markets in Arlington, eating at Pupatella Neapolitan Pizzeria and El Fuego Peruvian Kitchen,” Silva said. “I think that coming from extreme poverty has made me really appreciate all of the affluence and prosperity that Arlington has to offer.”

Quigley lives the charmed life just off Four Mile Run in South Arlington.

He loves relaxing, long walks, hard 5K to 10k runs, dips in the water, and confounding his mama with his odd food choices and occasional hunger strikes.

Much like his human buddies, he lives for the weekend and hikes in the mountains, especially at his grandma’s house in Blacksburg.

Always eager to please, he keeps his mama safe from UPS trucks, delivery vehicles and phantom passersby.
