At least two U.S. cities are using automated noise enforcement technology. Should Arlington?

Knoxville, Tennessee recently deployed a noise-monitoring camera as a test to see whether it helps to stem rising noise complaints downtown. From local TV station WATE:

Data that will be collected includes the time and date of a noise violation, the vehicle type and a photo of the vehicle’s license plate.

The camera footage cannot be be used alone as the basis for issuing a noise violation but warnings may be issued. The city release said the trends that are verified by the data can lead to more effective enforcement.

New York City also reportedly has a system that sends out warnings to drivers whose cars are too loud.

Arlington may not be able to deploy such a system without legislative authorization, given that Virginia is a Dillon Rule state. But, if the county can get the authorization, should it?

Excessive noise from cars and motorcycles became a more frequent complaint in Arlington over the course of the pandemic. Meanwhile, a law originally proposed by a local legislator, and intended to reduce racial disparities in traffic stops by prohibiting noise being used as a pretext for pulling drivers over, has made enforcement more difficult. An automated system could address both both issues.

(Updated, 4:05 p.m.) As a new aircraft noise study comes in for a landing, Arlington officials admit there remains little the county can actually do about the noise above.

“I know how frustrating this is. I think people don’t understand how little power we actually have,” says Arlington County Board member Libby Garvey. “We really have almost zip.”

They’re not hopeful they can get the Federal Aviation Administration on board with changes, such as shifting National Airport’s flight patterns to less populated areas. A work group plans to ask the agency to shift incoming planes away from more developed areas and is expected to recommend doing the same for departures.

For years, residents have complained about aircraft noise, resulting from the flight patterns in and out of National Airport as well as Pentagon-bound helicopters. It’s gotten marginally worse in recent years after the FAA adjusted flight patterns to push flight paths further west, away from D.C., due to the Secret Service’s concerns about commercial flights encroaching into federal no-fly zones (Prohibited Area 56). The new patterns resulted in complaints among Arlington residents who live close to the Potomac River, including those in Rosslyn.

In 2019, the Arlington County Board sent a letter to the FAA expressing its “strong opposition” to the changes while accusing the federal agency of not engaging with the community and doing something that is “quite possibly in violation of federal law.”

“Aircraft noise is a real thing,” Arlington County Board Member Takis Karantonis tells ARLnow. “It’s a quality of life issue for many Arlingtonians who live under or near flight paths.”

In May 2019, Arlington agreed to jointly fund a study with Montgomery County that would recommend to the FAA ways to reduce aviation noise and limit the impact on residents.

Now, after nearly three years, the “Aircraft Noise Mitigation Study” is reaching its conclusion.

The biggest takeaway is that the study recommends diverting flight paths in and out of National Airport so that fewer people are living directly under them. That means prioritizing noise reduction in more dense and populated areas, as well as “noise sensitive residential areas,” to the extent possible. The study also looked at how takeoff speed, trajectory, and height impact noise.

Last summer, new flight paths for incoming flights were proposed and, just this past December, departing flights were discussed. In addition to shifting paths, a recommendation was made for departures to be split into multiple segments so that there would be a “more equitable distribution of noise.”

The incoming flight paths were approved by DCA Community Working Group, which operates under the Metropolitan Washington Airports Authority (MWAA), and the departure paths will be reviewed in April.

It’s expected those recommendations, with possibly a few tweaks, will be approved and proposed to the FAA. But officials are skeptical of whether the FAA and federal agencies take them into consideration.

“Arlington County against the federal government is kind of a little unbalanced in terms of a power setup,” Garvey said, echoing what she said at last week’s recessed Board meeting.

That’s one of the reasons Arlington partnered with Montgomery County on the aircraft noise study, so that two jurisdictions could come together with credible data to ask the FAA and Secret Service to make changes.

The counties are also in talks with D.C. and other local jurisdictions to apply more pressure to the federal agencies. But she understands why some residents may feel like just doing a study is not enough.

“Our residents who are frustrated with the noise see nothing [being done] and they’d like us to sue the FAA or something like that,” says Garvey. “I understand the desire to do that, but that actually would be very counterproductive and not actually get us anywhere.”

It appears that Bowlero — an allegedly rowdy Crystal City bowling alley at the base of apartments — won’t be headed to the gutter this year.

The Arlington County Board this weekend is set to renew use permits for Bowlero (320 23rd Street S.) sparing it from closure, on the conditions that staff will review its operations next January, closely monitor the business in the meantime and review it again in 2025.

But the relationship between the bowling alley and the residents of The Buchanan apartments above it is uneasy. There have been dozens of reports to Arlington County Police Department of fights, drunk and loud patrons, indecent exposure and damaged property.

It reached a point where ACPD hosted an online town hall on March 31 last year to hear tenants’ concerns and discuss the work by officers and Bowlero staff to get crowds under control.

Eighteen months after opening, Arlington County is recommending the Board renew Bowlero’s permits with the one-year review to make sure community concerns about night-time nuisances are minimized. Since it opened in July 2020, there have been nearly 70 calls for service to ACPD.

The county says it supports renewing the permits because the quality-of-life problems caused by rowdy patrons are being addressed through the Arlington Restaurant Initiative (ARI), a partnership between ACPD and restaurants and bars to make Arlington a safe nightlife destination.

Otherwise, it says in a county report, staff found no other problems with the business operating there.

The police department supports the renewal because Bowlero maintains the restaurant initiative accreditation it earned in October 2020, per the report. The alley’s management plays an active role in involving police, ACPD said in the town hall, making half of the 52 calls for service between July 2020 and March 31.

“Bowlero has also implemented proper security measures and best practices, as recommended by Arlington County Police Department (ACPD), for calming and managing crowds, in addition to proactively responding to pending reports on site,” the report said. “The Police Department has not identified any outstanding public safety issues related to the continuation of the subject use.”

These security measures include scanning people with wands and checking bags, the report says. In addition, a neighborhood liaison has been appointed to address residents’ concerns.

Still, members of a nearby civic association have expressed their concerns “about reports of a high volume of late-night noise and potentially dangerous activity related to patrons of the establishment,” the report said.

One former resident, who moved away partially because of the nuisances downstairs, said metal detectors and police’s best practices are “treating the symptoms” but not addressing their root causes: alcohol, prices, promotions and hours.

The permits allow Bowlero to operate from 11 a.m. to 2:30 a.m. Monday through Friday and from 10 a.m. to 2:30 a.m. Saturday through Sunday.

The former Buchanan resident said the calls to police detailed in the report — chiefly calls about fights and loud and drunk patrons — “seem typical of what I experienced.”

“They are absurd,” he said. “Gun issue? Street fights? Woman exposing herself? These are not just noise complaints, nor was this U Street [a street in D.C. known for its nightlife] prior to Bowlero opening. It was a calm and pretty safe street that turned into a place to actively avoid.”

(Updated, 4:40 p.m.) Loose steel plates on Columbia Pike that are keeping residents up at night with the sounds of cars driving over them are the work of a general contractor doing 5G work.

The same contractor also damaged a gas line on the Pike causing a large gas leak last week, according to Washington Gas.

The plates were recently installed on the 1800 block of Columbia Pike, prompting complaints from residents who say that they are rattling and banging loudly when passing vehicles drive on them. The plates are the result of work done by contractor Crown Castle, a spokesperson for the Arlington Dept. of Environmental Services tells ARLnow.

“We’ve determined those annoyingly loud plates on Columbia Pike to be the work of a 5G contractor,” spokesperson Peter Golkin tells ARLnow. “Our Construction Management and Permits folks have been investigating and will work to get the plates secured and end the racket as soon as possible.”

The racket was first brought to both ARLnow’s and the county’s attention by rattled citizens on social media.

Crown Castle blames the rattling steel plates on a general contractor working for the telecom infrastructure company. The steel plates have since been removed and replaced it with asphalt, a company spokesperson has confirmed to ARLnow.

“Crown Castle continues to expand our infrastructure in Arlington to provide connectivity to the community. One of Crown Castle’s general contractors was conducting work to support network enhancements for our enterprise and wireless customers, including 5G,” wrote a company spokesperson. “The temporary steel plate has been removed and has been replaced with asphalt. Final restoration will be completed in the coming weeks as we coordinate with the county and account for holiday schedules.”

Washington Gas tells ARLnow that the contractor is also responsible for damaging a gas line near S. Scott Street during the course of this work. That resulted in Columbia Pike between Quinn Street and S. Walter Reed Drive being shut down for several hours.

“Washington Gas recently conducted repair work to a natural gas line that was damaged by a third party contractor on Columbia Pike,” a spokesperson for the natural gas provider wrote.

Crown Castle confirmed to ARLnow that its general contractor damaged the gas line.

“We coordinated with Washington Gas and the county to quickly address and repair the situation and restore service,” the spokesperson wrote.

A short distance away from the newly-repaired gas line, the rattling steel plates remained until at least Friday afternoon, when an ARLnow photographer observed the scene. While there, the photographer saw that crews had removed some of the plates to continue work below.

DES said at the time that it was investigating and asking the contractor to fix and secure the plates as well as lower the noise level in general. Golkin said the county appreciates the outreach from residents.

“We want [to] thank the nearby residents for alerting the County directly and through social media,” he said.


(Updated 2:15 p.m.) The county has crystallized plans for temporarily storing and dispatching Arlington Transit (ART) buses near Washington-Liberty High School while a new bus facility in Green Valley is built.

Nearly 30 ART buses will come and go from the site, on the 1400 block of N. Quincy Street, where the county currently parks some fire and police vehicles, as well as a portion of the Arlington Public Schools vehicle fleet. The site also has warehouse storage for Covid-related supplies and serves as the drop-off center for E-CARE recycling events.

In 2015, the county agreed to pay $30 million to acquire the six-acre property, which is across from W-L to the west, I-66 to the north and houses to the south and east.

Meanwhile, construction on the Shirlington Road facility in Green Valley — intended to address the need for more space to park and maintain Arlington’s growing fleet of ART buses — is expected to start in the summer of 2022, Department of Environmental Services Director Greg Emanuel told the County Board during its recessed meeting yesterday (Tuesday). The county bought that site, along the 2600 block of Shirlington Road, for $24 million in 2018.

Ahead of construction, DES says it has to move 41 buses, including 12 to a bus site on S. Eads Street, which opened in 2017 near Crystal City. The other 29 are going to the N. Quincy Street site because it’s the only available and affordable site zoned for vehicle storage, Emanuel says.

Buses will be parked at and dispatched from the N. Quincy Street site on weekdays, with a majority of movement happening between 5 a.m. and midnight, he said. Weekend operations will be run out of the Crystal City facility.

Although the facility neighbors the high school, DES says traffic related to school pickup and drop-off should not pose a problem.

“We don’t anticipate conflict with W-L traffic across the street because the peaks are outside the normal peaks here,” Emanuel said.

Still, the news is not exactly welcome among some neighbors, who told the County Board and county staff their concerns about noise during quiet hours, as well as how this decision was communicated. Residents previously opposed the relocation of APS bus parking to the Virginia Square site, also known as the Buck site.

Board members indicated support for the temporarily relocation but said they were sensitive to residents’ concerns.

A noise study conducted earlier this year concluded that the new bus activity will increase noise levels upwards of three decibels, with overall noise “still in the comfortable range,” Emanuel says. Currently, a row of trees lines the southern edge of the property, but additional noise mitigation measures are a possibility down the road.

Arlington County Board Vice-Chair Katie Cristol said the county needs to make long-range plans for building attractive, landscaped noise buffers, as the site will continue to support other “back-of-house functions” for northern parts of Arlington.


Fire Station 8 Now in Temporary Home — “On December 6th, 2021, The Arlington County Fire Department relocated Fire Station 8 into their new temporary quarters ahead of the construction of a new station. The temporary Fire Station 8 is located at 2217 N. Culpepper St, just behind the location of where the old Fire Station 8 stood for decades. Construction could start on the second phase of the Red Top Cab development in Clarendon within the next month or two.

“We are hoping to start the project before the end of the year. It all lies in the County’s hands as we continue to pursue our permits,” said Kelly Shooshan, CEO of Arlington-based developer Shooshan Company.

This is the second of two phases for the project, dubbed “Clarendon West,” by Shooshan and and partner Trammell Crow Residential. In 2015, the Arlington County Board approved a proposal for a three-building mixed-use development, replacing the old Red Top Cab headquarters and dispatch center, and two small commercial buildings.

The first phase was comprised of two buildings on N. Hudson Street and 13th Street N., with a total of 333 apartment units. Shooshan says construction broke ground on the pair of buildings in March of 2019 and was completed this spring, with leasing having started in February. The complex, dubbed The Earl Apartments, was sold to another property owner in July.

The second phase at the corner of Washington Blvd and 13th Street N. is comprised of one multifamily building with 269 units, according to plans filed in December 2020. Shooshan says will likely be completed by the end of 2023 or in early 2024.

Last Saturday, project representatives — who said construction is expected to start in November — made a pitch for one extra hour of work on Saturdays. They said it would shave up to two months off of the end date. The approved construction hours are 7 a.m. to 6:30 p.m. on weekdays, and 10 a.m. to 6:30 p.m. on weekends and holidays.

“This request has gone through multiple iterations based on outreach with the community,” said attorney Matt Roberts of Bean, Kinney & Korman. “It’s going to improve the construction schedule for the project, which is going to have a direct and immediate benefit to the community by providing less time overall for construction.”

Starting an hour earlier allows workers to get in a full day’s worth of work sooner, said Adam Stone, representing Trammell Crow Residential. Construction sites with earlier start times are more competitive because workers can get done and get home earlier in the day, he said.

Their request differed from what Shooshan had initially requested the Board to consider: 7 a.m. to 7 p.m. on weekdays and 9 a.m. to 7 p.m. on weekends and holidays.

These hours, which county staff analyzed, drew opposition from the Lyon Village, Ballston-Virginia Square and Clarendon-Courthouse civic associations, and St. Charles Catholic Church, according to a county report. The homeowners association for the Bromptons at Clarendon townhomes and two local residents, however, said the extension was fine.

Roberts said the church reversed its position when Shooshan returned the Sunday construction time to 10 a.m.

Following the recommendation of county staff the County Board denied what Board Member Libby Garvey called an “eleventh-hour” request for extended hours. Members were skeptical that the community would actually benefit from longer work hours and a shortened schedule.

“We’re dealing with a lot of construction in Arlington, it’s really difficult for residents to be going through that,” Garvey said. “I know while an hour on a Saturday might not seem like much to people, that might be a pretty big difference for people who live in the area.”

With the opening of a new concourse at Reagan National Airport, aircraft noise above Arlington remains at a high volume and the region is still studying ways to mitigate the roar.

Resident complaints about noises overhead have been constant for years, due to the flight patterns into National Airport and Pentagon-bound helicopters. Most of complaints are from those who live near the Potomac River, which is the general flight path of most jets arriving and departing the airport.

Last week, at the official celebration for the opening of DCA’s new concourse, Congressman Don Beyer bid “good riddance” to the infamous Gate 35X, assuring residents the new gate won’t exacerbate noise.

“While the new facilities will improve the passenger experience, this will not lead to increased flights or aircraft noise, a frequent concern in the region,” he later said in a tweet. “And I will continue the work to mitigate aircraft noise in our area!”

This year, several separate studies and reports have floated potential solutions to quieting the skies. One study, commissioned by Arlington County and Montgomery County, is ongoing, as the scope shifts from inbound to outbound aircraft.

The joint study advised in April to reroute incoming aircraft so they increasingly fly over the Potomac River instead of “residential and noise-sensitive areas.”

The recommendations were made to the Reagan National Community Noise Working Group (CWG), which operates under the Metropolitan Washington Airports Authority (MWAA).

CWG in turn passed them onto the Federal Aviation Administration, though it remains unclear if and when the FAA will act on the suggestions.

The conclusions and process have upset some residents of North Arlington neighborhoods located near the river. During public comments at the Sept. 18 County Board meeting, Chain Bridge Forest resident Alice Doyle said the altered flight paths would cause her and neighbors to bear the brunt of noise.

“To be clear, this means that neighborhoods like Chain Bridge Forest and Arlingwood that sit near the Chain Bridge not only see zero relief from airplane noise, we will now see and hear even more flights overhead,” she said. “The flight disturbance over our homes is almost constant with occasional periods of relief. Under this plan, those much needed moments of noise relief will disappear. ”

She also criticized the county for being “half tuned into the process” and not having enough representatives at the CWG meeting.

County Board member Libby Garvey responded that she understood Doyle’s concerns, but said the report recommends shifting the flight patterns to lessen the burden on Arlington’s more populated areas.

She reiterated in federal issues such as this one, the best county officials can do is to make recommendations.

Now, the joint study has a new focus: departing flights, Arlington County spokeswoman Bryna Helfer tells ARLnow.

“Technical work on new draft procedures for north-flow departures is currently the focus of the study and a community meeting to present those draft procedures will be scheduled before the end of 2021,” she wrote in an email.

In 2018, Arlington and Montgomery counties agreed to split the $250,000 cost of the study, which was officially launched in 2020. For the departing flights study, Arlington paid an additional $50,000, and Montgomery an additional $100,000, Helfer said.

CWG will meet again next Thursday, Oct. 28.

The U.S. Government Accountability Office (GAO) and the Department of Defense also completed studies this year. The GAO report from September recommends the FAA use easier-to-understand noise metrics.

On a quiet residential street near Arlington Blvd, cars can be heard accelerating as they turn a corner, with their aftermarket exhaust giving off a loud “roar.”

Meanwhile, near Columbia Pike, cars rev up and drag race on S. Columbus Street by Wakefield High School.

“I’m eight stories up — not at street level, so to speak — so maybe you expect the noise to dissipate,” Betsy Thomassen tells ARLnow. “It’s Wednesday, and it’s happened five to six times… it’s just incredibly loud and a nuisance. In my condo, my furniture sometimes vibrates. That’s kind of incredible really.”

According to residents who have spoken to ARLnow, and who’ve posted on social media sites like Facebook and Nextdoor, there been a surge in modified cars speeding through neighborhoods. Some residents say the uptick is particularly bad along the Columbia Pike corridor and in the Clarendon area, and along the highways that crisscross the county.

“Anywhere there’s a corridor, you have high performance cars,” said Clarendon-Courthouse Civic Association President David Cheek, who even compiled a video, below, of modified cars roaring through his neighborhood. “It’s really rude to accelerate in an area with a lot of people, in a loud car, but there’s a ‘do whatever you want’ mentality.”

After nearly a year of receiving more complaints than usual, the County Board is preparing to take a number of steps to mitigate noise in Arlington and enforce noise maximums on cars and motorcycles, according to Board member Takis Karantonis.

One avenue members are pursuing is via the state legislature. The Board aims to have something on their legislative agenda for the next regular session in January, Karantonis said. They’re also looking to train police officers to engage drivers in conversations and get them to change their attitudes.

“I think that the County Board as a whole is interested in a way to enforce and discourage overwhelmingly noisy motoring in Arlington, especially in neighborhoods,” he said.

Diagnosing the problem 

A lot of the especially noisy cars are running aftermarket exhaust systems made for racing, Cheek said. He theorizes that with extra time on their hands during the pandemic, more folks got interested in car modifications.

There is an entire, sophisticated industry around these mufflers, but there is very little regulation, Karantonis said, adding that he understands that modified cars sell like hotcakes in motoring and touring fairs.

One reader told ARLnow that the new noise isn’t always associated with higher speeds.

“They often ‘sound’ as though they are also speeding, yet I’ve seen several that are loud, but didn’t appear to be speeding,” one said. “I suspect that those nature of the modifications.”

As a car and motorcycle enthusiast, Cheek said he understands the appeal of modifying a vehicle and wanting to enjoy it.

“I feel for them,” he said. “But they have to understand there are a lot of people who’re upset about it — on Columbia Pike and in  Clarendon — and that it’s not fair to everyone else.”

He added that noise pollution “isn’t just annoying — it impacts your mental health, and it actually affects your life.”

Considering legislation

Karantonis said there are a few paths on the table, from enacting legislation to educating drivers.

Legislative action will be somewhat tricky, in part because a new state law went into effect in March that says police officers cannot initiate a traffic stop for, among other things, loud mufflers. The code still allows drivers to be ticketed for noise if they were pulled over for a violation such as speeding.

The law, sponsored by Del. Patrick Hope (D-Arlington), was passed to reduce racial disparities in traffic stops, as some police officers historically used pretextual reasons — such as a loud car or expired tags — to pull over residents and search their cars.
