A D.C. man will now spend nearly 30 years behind bars after he posed as a maintenance worker and then sexually assaulted a woman in Rosslyn.

Arlington County Circuit Court Judge Louise DiMatteo sentenced 25-year-old Richard Allen Lowe to 28 years in prison on Friday (Feb. 8). Lowe previously pleaded guilty to charges of unlawful wounding, abduction, burglary and sexual penetration back in August.

“The defendant preyed upon his victim’s sense of safety by posing as someone she should trust in her own home,” Police Chief Jay Farr wrote in a statement. “While nothing can completely restore her sense of security, our community is safer today because of the significant sentences imposed by the court on a violent offender.”

Prosecutors say Lowe entered an apartment building on the 1500 block of Key Boulevard around 9:45 a.m. on May 7, 2017, where he began knocking doors and claiming to be a maintenance worker.

When one woman opened her door, Lowe pushed past her into the apartment and sexually assaulted her before fleeing the scene. Detectives then relied on a “review of crime scene evidence, witness interviews and laboratory results” to identify Lowe as a subject, according to a news release.

Police then arrested Lowe in D.C. last February, and he pleaded guilty soon afterward.

“The sentence handed down by Judge Louise DiMatteo takes a dangerous predator off the streets and puts public safety front and center,” Commonwealth’s Attorney Theo Stamos wrote in a statement. “The defendant was brought to justice by the dogged work of Arlington County detectives who worked painstakingly to identity Lowe and link him to his crimes.”

JBG Smith is starting to sketch out its plans for a major redevelopment of a Crystal City property that will drop hundreds of new apartments and thousands of square feet of retail space directly adjacent to some of Amazon’s new office space in the area.

The developer has now filed preliminary plans with the county detailing the future of a vacant office building at 1900 Crystal Drive. The company has already started some demolition work for the current structure, and previously announced plans to build two new mixed-use buildings in its place, accelerating the project now that Amazon is on the way.

The tech giant plans to lease space at two of JBG’s properties on the same block, buildings at 241 18th Street S. and 1800 S. Bell Street, so this new development could offer Amazon workers with apartments within easy walking distance of the new headquarters.

Developers throughout the area have been racing to build new housing across Pentagon City and Crystal City since the company announced its plans in mid-November, though the neighborhoods do have slightly higher than average residential vacancy rates, for now.

JBG kicked off the redevelopment process in earnest in late January, asking for a slew of county zoning changes and a “site plan amendment” to key the full redevelopment of the block. The plans call for the construction of two large towers, holding a total of 790 apartments. One will be 26 stories tall, the other 25 stories.

Each one will also have space for ground floor retail: 19,390 square feet of space in one tower and 16,800 square feet in the other, according to documents filed with the county.

The developer is envisioning a “pedestrian plaza” in between the two buildings, with room for just under 9,000 square feet of retail in the plaza. The plans even allow for a park to be built nearby, though the documents don’t specify where, exactly, it will be located on the block — but if it is built, a “grand staircase” will connect it to the pedestrian plaza.

When it comes to parking, JBG plans to partially rely on the existing underground garage on the site. The developer plans to demolish part of the garage, but leave 306 spaces unchanged. Then, it hopes to add a new section of the garage with 290 new spaces for a total of 596 available in all.

The project is a long way from being approved, however — the county’s Site Plan Review Committee will now scrutinize these plans, before they head to the Planning Commission and County Board. Vornado/Charles E. Smith previously secured permission to build a 24-story building on the property, but that approval lapsed in 2015. The company spun off its local property holdings in a merger with JBG the next year.

This is far from the last redevelopment JBG is planning in the neighborhood in the coming years. In addition to its large “Central District” project (bringing a new movie theater, grocery store and office space to the area), the company previously told its investors that it could look to redevelop properties including 2001 Jefferson Davis Highway, 223 23rd Street S., 101 12th Street S., and the RiverHouse Apartments (1400 S. Joyce Street).

Though JBG is by far the largest property owner in the area — controlling about 71 percent of the market’s office buildings — county officials hope other landlords take similar steps to refresh nearby buildings.

As for Amazon itself, the company won’t file any plans with the county until the Board signs off an incentive package to formally bring the headquarters to the area. The Board won’t take up that issue any earlier than March.

(Updated at 9:30 p.m.) Arlington Del. Patrick Hope (D-47th District) now says he’ll introduce articles of impeachment to remove Lt. Gov. Justin Fairfax from office on Monday if he doesn’t step down, now that another woman has come forward to accuse the second-most powerful Democrat in the state of sexual assault.

Hope announced the move tonight just a few hours after Meredith Watson accused Fairfax of raping her when the pair attended school together at Duke University in 2000. She wrote in a statement that the details of her assault mirrored those laid out by Vanessa Tyson, who previously said that Fairfax assaulted her in a Boston hotel room in 2004.

Democrats had been hesitant to call for Fairfax to step down since Tyson’s statement, but pressure is now mounting for the lieutenant governor to step aside. Friday night, the state House and Senate Democratic caucuses released a joint statement, urging Fairfax to resign.

The Virginia Legislative Black Caucus issued a similar statement.

The bulk of Virginia’s congressional delegation has also demanded Fairfax’s resignation, including Arlington Rep. Don Beyer (D-8th District).

“Lt. Governor Fairfax has also shown exceptionally poor judgment in his handling of these allegations,” Beyer and Reps. Gerry Connolly (D-11th District), Elaine Luria (D-2nd District), Abigail Spanberger (D-7th District) and Jennifer Wexton (D-10th District) wrote in a statement. “He repeatedly attacked his accuser, he reportedly used vile and degrading language to describe her, he mischaracterized an investigation into the encounter, and he sought to blame others for events in his own past. These actions do not meet the standard to which we hold Virginia’s highest elected officers.”

For now, it would seem Fairfax is resisting pressure to step aside.

Gov. Ralph Northam (D) has been similarly steadfast in the face of calls to resign over a racist photo on his medical school yearbook page, writing an email to state employees today saying he does not plan to step down. The fate of Attorney General Mark Herring (D) is also unclear, after he revealed he wore blackface while in college.

Earlier today, Hope posted a video on Twitter urging Northam and Herring to learn from their experiences, but stopped short of demanding their resignations. He’d previously supported calls for Northam to step down, but was silent on Herring, who he previously endorsed in Herring’s early stages of mounting a campaign for governor in 2021.

Hope said in the video that he believed Fairfax’s first accuser and thought an investigation was necessary.

Around 9 p.m. Friday, Hope held a press conference in front of Arlington Central Library in Virginia Square, laying out his case for the impeachment of Fairfax, should he refuse to resign. The press conference was attended by CNN, CBS, NBC and local D.C. stations.

Marymount University is buying a Ballston apartment complex adjacent to one of its other office buildings in the area, with plans to convert the space into upscale housing for its students and staff.

The university announced today (Friday) that it’s spending $95 million to acquire “The Rixey,” located at 1008 N. Glebe Road. The building opened in October 2017, with a total of 267 apartments in the 15-floor structure.

The Rixey is located right next to the university’s Ballston Center at 1000 N. Glebe Road, which is home to several of Marymount’s undergraduate and graduate programs (in addition to a cafeteria and a Starbucks). By buying up the apartment building, the university hopes to provide “apartment-style city living” for undergrad students in addition to its on-campus residence halls, and also offer “significant housing options to Marymount University’s veterans, families, graduate and international students,” according to a news release.

“This new acquisition further cements Marymount as an anchor of the Arlington community,” Marymount staff wrote. “This multimillion-dollar facility provides walking-distance access to Marymount graduate programs at Ballston Center, shuttles to Marymount campuses and Metro access, making the building an accessible living-learning community.”

Amenities at the building also include “an expansive fitness center with Peloton bikes and a yoga room, a bike repair station, a rooftop clubroom with views of D.C. and a lounge with cabanas and TVs,” the release said.

A spokeswoman for the university did not immediately respond to a request for comment on whether anyone is currently renting an apartment in the building, or what might become of current renters following this acquisition.

The university added in the release that it managed the acquisition with a combination of state funds and private financing.

Marymount also maintains space at 4040 Fairfax Drive in Ballston, in addition to its main campus at 2807 N. Glebe Road.

Four years ago, Arlington officials spent $4.1 million to build a 10-mile fiber optic network aimed at allowing local businesses to get cheaper access to higher-speed internet — since then, the fiber has just sat in the ground, almost totally unused.

At the time, county leaders championed the construction of the “dark fiber” network as a transformative step for Arlington. Though the county is barred by state law from offering internet service itself, officials envisioned smaller internet service providers working with local tech firms to “light” the fiber, providing county businesses with a powerful new option to access the internet at blazing-fast speeds.

But an ARLnow investigation shows that Arlington officials made a series of decisions in designing the program that scared off any businesses interested in leasing the fiber.

A committee of broadband experts convened by the county laid out many of these problems with the network, dubbed “ConnectArlington,” in a thorough report recommending an extensive overhaul of the program’s design. At least one member compared ConnectArlington to the infamous — but never built — “bridge to nowhere” in Alaska.

County officials, including County Manager Mark Schwartz, have now been aware of the group’s conclusions for close to eight months and they say they’re already hard at work to heed some of the committee’s recommendations. The report has even since been forwarded along to the County Board, even though Schwartz had originally hoped to wait to deliver his own recommendations for the program alongside the committee’s conclusions.

Now, it remains an open question how the county will work to address the problems with ConnectArlington, which costs hundreds of thousands of dollars per year for the county to maintain.

“They have this huge amount of fiber in the ground, and not a single strand of it has been leased,” said Chris Rozycki, a member of the Broadband Advisory Committee that studied ConnectArlington. “It’s like they’ve built an interstate, with no on-ramps or off-ramps.”

Fiber frustrations

The Board decided to build the 10-mile network in February 2015, reasoning that it would be a logical extension of the county’s existing fiber network, which connects county facilities, schools, radio towers and traffic signals.

Then-County Board member Jay Fisette touted it to ARLnow at the time as a “competitive advantage over other jurisdictions,” positioning it as a key tool for economic development in the county. It was also designed as a way to provide more competition for large ISPs like Verizon and Comcast — the county’s own research shows that companies at roughly 60 percent of all county office buildings only have one ISP able to offer them fiber-based service.

But the network’s design and the county’s conditions for leasing out the fiber were flawed from the very beginning, according to the broadband committee’s report and interviews with four of the group’s six members.

A chief concern is how the county chose to build out the fiber. Officials designed it as “middle mile” service, meaning it runs along major roadways (along the Rosslyn-Ballston corridor and Columbia Pike, for example) but didn’t initially connect to the buildings along the corridors.

“To be useful, the network must be complete,” the report argues, according to a copy obtained by ARLnow. The report has not been publicly released by the county.

“‘Build it and they will come’ does not always work,” the committee wrote. “Part of the network was built, but not enough to bring the ‘players’ to the game.”

Republican lawmakers have scuttled Gov. Ralph Northam’s proposal to ramp up state funding for affordable housing, a move that’s irked advocates hoping for more state help as Amazon starts to move into Arlington.

GOP leaders in both the state Senate and House of Delegates have now put forward budget proposals without the $19.5 million spread across two years Northam had hoped to see flow into the Virginia Housing Trust Fund, a program offering low-interest loans for developers hoping to build reasonably priced housing.

Though the fund would be available to applicants across the state, the governor’s effort to massively ramp up cash flowing into the fund was broadly seen as a small way the state could prepare for Amazon’s expected impacts on the housing market across the Northern Virginia region.

“We are outraged that selected members of Virginia’s money committees stripped this critical support for housing for Virginia families,” a coalition of 40 affordable housing advocacy groups wrote in a statement. Signatories include the Arlington Partnership for Affordable Housing, the Arlington Housing Corporation, the Alliance for Housing Solutions, the Arlington Street People’s Assistance Network and the Northern Virginia Affordable Housing Alliance.

“At a time when the state is approving $50 million in subsidies to Micron and $750 million to Amazon, it is wholly appropriate and necessary to invest $19.5 million in housing,” they wrote.

The Senate’s proposed budget includes just $1 million for the fund over the next two years, while the House proposal includes no cash whatsoever.

Northam had planned to fund the increase as part of a suite of proposals to use $1.2 billion in new revenue generated by the federal tax reform passed in 2017. But Republicans, who hold narrow majorities in both chambers in the General Assembly, have been steadfast in removing those spending proposals from the budget as part of a broader fight over the tax revenues, arguing that the state would be better served by sending the money back to some middle-class taxpayers.

“We started building our budget with guidelines to remove from consideration any revenue based on the federal tax changes and to eliminate any spending based on that revenue,” said Del. S. Chris Jones (R-76th District), the head of the powerful House appropriations committee. “We are continuing our multi-year efforts to responsibly invest in a stronger economy, provide more funding and flexibility to local schools and make college more affordable.”

Del. Alfonso Lopez (D-49th District) was hoping for an even larger, $50 million influx into the fund on a one-time basis, yet that push is seemingly facing an uphill battle given the latest GOP budget proposal. He’d also proposed a bill to establish a permanent funding stream for the fund to avoid yearly appropriations battles, but that died on a party-line, 4-3 vote in a House subcommittee.

The budget is still a long way off from being finalized, however. The House and Senate still need to reconcile the differences between the two proposals and, ordinarily, Northam would have a chance to negotiate for his spending priorities with Republican leaders.

But with the governor still facing pressure to resign, and Virginia’s two other top elected officials now engulfed in scandal, there’s no telling just how the remainder of the General Assembly session will play out. It’s currently set to wrap up on Feb. 23.

There’s an ongoing war being fought on the streets of Arlington.

The skirmishes are fought amongst us daily, for turf, for respect, for safety — and, some would say, for outright survival. The combatants are cars and bicycles, jockeying to safely share a common infrastructure.

Arlington has long prided itself as a “bike friendly” locale. Every bicycle on an Arlington street is potentially one less car on the road, thus reducing traffic congestion and pollution.  Cycling also meshes nicely with Arlington’s reputation as one of the fittest communities in the nation.

Consequently, the county has taken numerous steps toward encouraging bike ridership. Recent years have seen the addition of many miles of dedicated bike lanes, including protected lanes, a move supported by a majority of Arlingtonians. Further, Arlington’s enviable network of interconnected bike paths provides a safe and efficient venue for pedal-powered transportation.

But it’s not always possible to physically separate bikes and automobiles. The problem arises from the fact that two modes of transportation, consisting of vehicles of differing size and weight, traveling at different speeds, with different degrees of visibility, often must share the same physical space.

Far too often, the two sides view each other as adversaries. One Arlington cyclist cited his top complaints against motorists as “parking/standing totally or partially in the bike lanes, and not allowing the Virginia state three-foot minimum of clearance when passing a cyclist.”

Drivers find their share of faults in cyclists, as well. “They act as if traffic laws don’t apply to them,” said one motorist. “So many times I’ve waited to safely pass a bicyclist on the road, only to have them zoom by me when I stop at a red light. They then blow through the light, and I have to wait to pass them all over again.”

Undoubtedly, there is bad behavior on both sides. And while these actors may represent only a small portion of each group, they are the ones that tend to stick out, not the majority of thoughtful, law abiding Arlingtonians.

Arlington County law enforcement officials monitor all modes of transportation for potential safety infractions, not merely automobiles.

“The police department’s overall vision for transportation safety in Arlington County focuses on the safety of all travelers. We encourage all who use our roadways to comply with the law and proceed with care and caution to ensure their safety and the safety of others who may be sharing the roads,” said county police spokeswoman Kirby Clark. “Officers observing traffic violations issue citations, based upon their discretion, to travelers, regardless of their mode of transportation.”

The stakes for cyclists are high — according to ACPD’s 2017 Annual Report, there were 80 bicycle-related crashes in Arlington County in 2017, ending a multi-year downward trend. There were 32 such crashes reported in 2016 and 46 in 2015.

It doesn’t require a degree in physics to understand that in a direct encounter between the two, bicyclists are at a far greater safety risk than are drivers. As one cyclist put it, “Any generally bad driving behavior and/or willful ignorance of traffic laws is exacerbated when you are cycling since one doesn’t have the protection of sheet metal and the bulk of a car.”

Arlington County has taken a number of steps in working toward a negotiated truce between the two sides.

The Bicycle Advisory Committee (BAC) advises the County Manager on issues that affect cycling in Arlington, including safety, education, community involvement, awareness and promotion, and the development, operation and maintenance of on- and off-street bicycle transportation and recreation facilities. Elsewhere, county staff and members of a citizens working group are in the final stages of developing a draft update to the Bicycle Element of Arlington County’s Master Transportation Plan.

Education is a critical element of the solution, as well. The county’s PAL program — encouraging drivers, bicyclists and pedestrians to be Polite, Alert and Predictable — seeks to educate all Arlingtonians about ways that they can remain safe regardless of their selected mode of transportation.

The Safe Bicycling Initiative (SBI), a cooperative venture between ACPD and BikeArlington, utilizes education and enforcement to make Arlington’s roads safer for bicycles. SBI’s targeted enforcement throughout the county resulted in numerous citations of both bicyclists and motorists, all of which served as an opportunity for police to increase awareness of the SBI and related traffic laws.

In the end, however, the solution lies out on the roads. The “us versus them” mentality adds to the problem, not the solution. It is critical to respect all users of shared spaces, and to look out for their safety needs. Both sides need to be well educated, and need to be willing and able to put that knowledge into practice.

And when somebody, somewhere, does something wrong — as they inevitably will — it’s important to realize that they are merely an individual behaving badly, and not representative of an entire group.

While such efforts will not be easy, they will make Arlington’s roads safer, and less stressful, for all.

Two more companies are planning to bring their dockless scooters and e-bikes to Arlington in the coming days.

Spin will soon be dropping its electric scooters around the county, while Jump will offer both e-bikes and scooters in Arlington. Both companies currently operate in D.C.

Ariella Steinhorn, a Spin spokeswoman, told ARLnow that the company’s scooters will be available for Arlingtonians to rent starting Friday (Feb. 8).

Jump has told local officials that they will follow suit “within the next few weeks,” according to county transportation spokesman Eric Balliet. The company did not immediately respond to a request for comment on its plans.

The companies will become the fourth and fifth firms to offer dockless vehicles in the county when they arrive, joining Bird, Lime and Lyft. All of the companies are participating in a pilot program set up by the County Board last fall, allowing firms to deploy hundreds of the devices around Arlington through the end of the tentative test period this summer.

The county generally hasn’t recorded too many problems with the suddenly ubiquitous scooters thus far, outside of some scattered accidents and concerns about younger riders using the devices when they shouldn’t be.

State lawmakers are also currently hard at work crafting legislation to allow localities to set additional regulations for the vehicles once similar pilot programs end.

Both of the new firms are owned by much larger companies — the ridesharing service Uber owns Jump, while Ford recently acquired Spin.
